September 11, 2013 <br /> The regular meeting of the Everett City Council was called to order at 6:30 <br /> p.m., September 11, 2013 in the City Council Chambers of the Everett <br /> City Hall, Council President Moore presiding. Upon roll call it was found <br /> that Mayor Stephanson and Council Members Roberts, Moore, Murphy, <br /> Gipson, Bader, Stonecipher and Affholter were present. <br /> Council President Moore led the Pledge of Allegiance. <br /> The minutes of the September 4, 2013 City Council meeting were <br /> approved as printed. Council Member Gipson abstained from the vote. <br /> CITY ATTORNEY <br /> City Attorney Iles requested an executive session to be held at this time <br /> concerning a potential litigation matter pursuant to RCW 42.30.110(1)(i). <br /> The session is anticipated to last 20 minutes with a possible <br /> announcement to follow. <br /> MAYOR <br /> Mayor Stephanson expressed his deepest sympathy for those affected by <br /> the rain events on August 29 and September 5, 2013. He stated that the <br /> city will undertake measures to resolve all reasonable claims filed as a <br /> result of the two storm events. He explained that this is a two-step <br /> process that involves acceptance of the claim and then a determination of <br /> the appropriate amount of damages related to cleanup, restoration and <br /> the associated property damage. He stated that this situation is similar to <br /> the one that occurred in 2010. At that time there was mediation <br /> determined for some property owners, which was not taken and that will <br /> have to be included in the city's decision going forward. If the property <br /> owner does not have a backwater valve, they will have to make necessary <br /> improvements required by the city and/or execute a release form <br /> approved by the City Attorney's office as a condition of all claims settled <br /> by the city. Backwater valves will be installed on private property at the <br /> city's expense. He stated that all properties within the Sewer "M" project <br /> will also be required to have a backwater valve. The Mayor announced <br /> that staff will bring forward a policy recommendation to the city council <br /> 246 <br />
