r_ <br /> herein are qualified in their entirety by reference to the definitions contained in 24 <br /> CFR Part 92. <br /> II. PROGRAM REQUIREMENTS <br /> A. Uniform Administrative Requirements <br /> As required by 24 CFR § 92.505(b), the Agency shall conform its performance under <br /> this Agreement to the requirements of OMB Circulars Nos. A-110 (relocated at 2 CFR <br /> Part 215), A-122, and A-133, as applicable, and 24 CFR Part 84 as they relate to the <br /> acceptance and use of Federal funds under this Agreement. <br /> B. Other Federal Requirements <br /> The Federal requirements set forth in 24 CFR § 92.350 are applicable to the Agency <br /> as a participant in the HOME Program and as a subrecipient of ADDI funds. The <br /> requirements of that section include: nondiscrimination and equal opportunity; <br /> disclosure requirements; debarred, suspended or ineligible contractors; and drug free <br /> workplace. The Federal nondiscrimination requirements set forth at 42 U.S.C. <br /> § 12832 and relating to race, color, national origin, religion, sex, age and non- <br /> disqualifying handicaps also are applicable. <br /> C. Minority Outreach <br /> The Agency shall take affirmative action to encourage the use of minorities' and <br /> women's business enterprises (hereinafter "WMBE") in connection with HOME and <br /> ADDI funded activities. In order to meet this goal, the Agency shall, for all its Project <br /> contracts funded wholly or in part with City HOME or ADDI funds, demonstrate a <br /> good faith effort to attain 7.7% WMBE participation. The Agency shall submit an <br /> annual report to the City of Everett of all contracts over $1,000 funded by HOME and <br /> ADDI funds. <br /> D. Affirmative Marketing <br /> The Agency shall adopt and implement affirmative marketing procedures and <br /> requirements in compliance with 24 CFR § 92.351(a) for use of the HOME funds. <br /> The Agency shall submit the affirmative marketing procedures and requirements to <br /> the City for its review and approval. Affirmative marketing requirements do not apply <br /> to ADDI funds. <br /> E. Environmental Review <br /> 1. NEPA <br /> Pursuant to 24 CFR § 92.352(b)(1), the County retains responsibility for <br /> environmental review, decisionmaking and action for purposes of fulfilling <br /> requirements of the National Environmental Policy Act for each activity carried out <br /> HOME and ADDI Agreement between <br /> City of Everett and HomeSight <br /> !,:, 5 <br />
