r. <br /> The Agency shall repay to the City HOME and ADDI funds disbursed to it under this <br /> Agreement, upon the occurrence of any of the following events: <br /> 1 . The housing in which HOME and ADDI funds are invested does <br /> not meet the affordability requirements for the period specified <br /> in Sec 92.252.or Sec 92.254 ; provided that the Agency need <br /> only repay the amount of the reimbursement for the particular <br /> housing not meeting such affordability requirements or <br /> 2. The Project receives funds pursuant to this Agreement to <br /> reimburse it for activities subsequently found to be ineligible for <br /> funding; provided that, the Agency need only repay the amount <br /> of the reimbursement for the ineligible activity; or <br /> 3. The HOME or ADDI funds disbursed by the City are not used in <br /> accordance with program requirements and this Agreement <br /> provided that, the Agency need only repay the amount of the <br /> funds not used in accordance with program requirements and <br /> this Agreement. <br /> Any HOME funds to be returned to the City must be repaid to the City's HOME Fund <br /> local account. If the City is no longer in a consortium agreement with Snohomish <br /> County when the repayment is made, then the funds shall be remitted to Snohomish <br /> County. <br /> E. Reversion of Assets <br /> Upon termination or expiration of this Agreement, the Agency shall, pursuant to <br /> Section IV-H-4 of this Agreement, transfer to the City (i) any HOME or ADDI funds on <br /> hand at the time of such termination or expiration and (ii) its rights in any accounts <br /> receivable attributable to the use of HOME or ADDI funds. <br /> F. Certification Regarding Lobbying <br /> The Agency shall comply with Attachment H, which is incorporated herein by this <br /> reference, concerning prohibitions and requirements for disclosure and certification <br /> related to lobbying. <br /> G. Limitation on Consultant Compensation <br /> The rate of compensation of certain persons providing consultant services shall be <br /> limited as provided by 24 CFR § 92.358. <br /> HOME and ADDI Agreement between <br /> City of Everett and HomeSight <br /> 15 <br />
