I agree that the inaccuracy of any of the representations or warranties in this Section 10,or my
<br /> failure to comply with any of the covenants in this Section 10, shall be a default under this Deed of Trust
<br /> 11. Beneficiary may make or cause to be made reasonable entries upon and inspections of the Property,
<br /> provided that Beneficiary shall give me notice prior to any such inspection specifying reasonable cause therefor
<br /> related to Beneficiary's interest in the Property.
<br /> Any inspection is solely for Beneficiary's purposes in determining compliance with this Deed
<br /> of Trust and protecting Beneficiary's security, and is not for the benefit of me or any other person or class of
<br /> persons. Beneficiary shall have no obligation to communicate the results of any inspection to me or any other
<br /> person.
<br /> 12. In the event of a judicial foreclosure,the purchaser during any redemption period may make such
<br /> repairs and alterations to the Property as may be reasonably necessary for the proper operation,care,
<br /> preservation,protection and insuring of the Property;may make disbursements for taxes, assessments, casualty
<br /> and liability insurance, and liens not discharged by foreclosure of this Deed of Trust;and may pay any other
<br /> amounts due with respect to the Property during the redemption period. The cost of any such repairs and
<br /> alterations, and any other such amounts paid,together with interest from the date of the expenditure at the rate
<br /> provided in the judgment, shall be added to the amount required to be paid for redemption of the Property.
<br /> 13. Beneficiary may require me to pay any or all of the following in connection with this loan:
<br /> (a) Premium for Beneficiary's title insurance;
<br /> (b) Escrow and recording fees;
<br /> (c) A one-time charge for a real estate tax verification and/or reporting service used by
<br /> Beneficiary in connection with this loan;and
<br /> (d) A one-time charge for flood hazard zone determination,certification,and tracking services,
<br /> and subsequent charges each time remappings or similar changes occur that reasonably might affect the
<br /> initial determination or certification.
<br /> I authorize Beneficiary to deduct such charges from proceeds of the loan,or from any funds that may be held by
<br /> Beneficiary for my account.
<br /> 14. Hazardous Substances. As used in this Section:
<br /> (a) "Hazardous Substances"are those substances defined as toxic or hazardous substances,
<br /> pollutants,or wastes by Environmental Law and the following substances: gasoline,kerosene, other
<br /> flammable or toxic petroleum products,toxic pesticides and herbicides,volatile solvents,materials
<br /> containing lead,asbestos or formaldehyde, and radioactive materials;
<br /> (b) "Environmental Law"means federal laws and laws of the jurisdiction where the Property is
<br /> located that relate to health, safety or environmental protection,as now in effect and as hereafter
<br /> amended or supplemented;
<br /> (c) "Environmental Cleanup"includes any response action,remedial action,or removal action,as
<br /> defined in or required by Environmental Law, and any removal or other abatement of any storage tank
<br /> required by law; and
<br /> (d) an"Environmental Condition"means a condition that can cause or contribute to the need or
<br /> requirement for an Environmental Cleanup.
<br /> I shall not cause or permit the presence,use,disposal, storage, or release of any Hazardous Substances, or
<br /> threaten to release any Hazardous Substances,on,under or in the Property. I shall not do,nor allow anyone else
<br /> to do, anything affecting the Property(a)that is in violation of any Environmental Law, (b)that creates an
<br /> Environmental Condition,or(c)that,due to the presence,use,or release of a Hazardous Substance,creates a
<br /> condition that adversely affects the value of the Property. The preceding two sentences shall not prohibit the
<br /> legal presence,use,or storage on the Property of small quantities of Hazardous Substances that are generally
<br /> recognized to be appropriate to normal residential uses and to maintenance of the Property(including,but not
<br /> limited to, small quantities of Hazardous Substances in consumer products).
<br /> I shall promptly give Beneficiary written notice of(a)any investigation,claim,demand,lawsuit or other action
<br /> by any governmental or regulatory agency or private party involving the Property and any Hazardous Substance
<br /> or Environmental Law of which I have actual knowledge, (b)any Environmental Condition,including but not
<br /> limited to,any spilling,leaking,discharge,release or threat of release of any Hazardous Substance, and(c)any
<br /> condition caused by the presence,use or release of a Hazardous Substance,or by the presence of any storage
<br /> tank,that reasonably may adversely affects the value of the Property. If I learn,or am notified by any
<br /> governmental or regulatory authority,or any private party,that any removal or other remediation of any
