I <br /> meet or exceed the assigned DBE COA Goal. That being the case, no <br /> additional GFE documentation is required. Or; <br /> 2. By documentation that the Bidder made adequate GFE to meet the DBE I <br /> COA Goal <br /> The Bidder may demonstrate a GFE in whole or part through GFE <br /> documentation ONLY IN THE EVENT a Bidder's efforts to solicit sufficient <br /> DBE participation have been unsuccessful. In this case, the Bidder must <br /> supply GFE documentation in addition to the Disadvantaged Business <br /> Enterprise Utilization Certification, and supporting Disadvantaged <br /> Business Enterprise (DBE) Written Confirmation Document(s). <br /> Note: In the case where the Bidder was awarded the contract based on 111 <br /> demonstrating adequate GFE the advertised DBE COA Goal will not <br /> be reduced to the Bidder's partial commitment. Further, the Bidder <br /> shall demonstrate a GFE during the life of the Contract to attain the <br /> DBE COA Goal as assigned to the project. <br /> GFE documentation shall be received, as specified in the special provisions for 1 <br /> Section 1-02.9 Delivery of Proposal. <br /> Based upon all the relevant documentation submitted in Bid or as a supplement to , <br /> Bid, the Contracting Agency shall determine whether the Bidder has demonstrated <br /> sufficient GFE to achieve DBE participation. The Contracting Agency will make a <br /> fair and reasonable judgment of whether a Bidder that did not meet the DBE COA <br /> Goal through participation, made adequate good faith efforts as demonstrated by <br /> the GFE documentation. <br /> Good Faith Effort (GFE) Documentation 111 <br /> GFE is evaluated when determining award of a prime contract that has an <br /> assigned DBE goal; when a COA DBE is terminated and substitution is required; <br /> and post award when determining whether the Contractor has satisfied its DBE <br /> commitments. <br /> The following is a list of types of actions, which would be considered as part of the I <br /> Bidder's GFE to achieve DBE participation. It is not intended to be a mandatory <br /> checklist, nor is it intended to be exclusive or exhaustive. Other factors or types of <br /> efforts may be relevant in appropriate cases. Responding to all GFE listed in 49 <br /> CFR Part 26, Appendix A does not, in itself, demonstrate adequate good faith <br /> efforts. <br /> 1. Soliciting through all reasonable and available means (e.g. attendance at <br /> pre-bid meetings, advertising and/or written notices) the interest of all <br /> certified DBEs who have the capability to perform the Work of the <br /> Contract. The Bidder must solicit this interest within sufficient time to allow <br /> the DBEs to respond to the solicitation.
