16 <br /> D. Documentation of monitoring service shall be provided with the submittal of <br /> plans. <br /> Section 13: Section 12 of Ordinance No. 1902-92 (EMC 16.76.120),which reads as <br /> follows: <br /> Authority to abate. <br /> A. Any violation of this chapter is declared to be a nuisance. <br /> B. Where a nuisance exists,the city attorney on behalf of the city is authorized to <br /> institute injunction,mandamus or other appropriate action or proceeding to prevent <br /> the violation of this chapter. <br /> C.Notwithstanding subsection B of this section,the city attorney is authorized to <br /> apply to any court of competent jurisdiction for such court,upon hearing and for <br /> cause shown,may grant a temporary or permanent injunction restraining any person, <br /> firm and/or corporation from violating any provision of this chapter and compelling <br /> compliance herewith. The cost of such action shall be taxed against the violator. <br /> D. A conviction of any person, firm or corporation for violating this chapter shall <br /> not impede the authority granted in this section to the city attorney or city. <br /> Is hereby amended to read as follows: <br /> Authority to abate. <br /> A. Any violation of this chapter determined to exist after inspection by the building <br /> official and/or fire code official is declared to be a nuisance. <br /> B. Where a nuisance exists,the city attorney on behalf of the city is authorized to <br /> institute injunction,mandamus or other appropriate action or proceeding to prevent <br /> the violation of this chapter. <br /> C.Notwithstanding subsection B of this section,the city attorney is authorized to <br /> apply to any court of competent jurisdiction and such court,upon hearing and for <br /> cause shown,may grant a temporary or permanent injunction restraining any person, <br /> firm and/or corporation from violating any provision of this chapter and compelling <br /> compliance herewith. If any section, subsection, sentence,clause,phrase or word of <br /> this ordinance should be held to be invalid or unconstitutional by a court of competent <br /> jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or <br /> constitutionality of any other section, subsection, sentence, clause, phrase or word of this <br /> ordinance. <br /> Section 15: Savings. The enactment of this ordinance shall not affect any case, <br /> proceeding, appeal or other matter currently pending in any court or before the City or in <br /> any way modify any obligation, right or liability, civil or criminal, which may exist by <br /> virtue of any of the ordinances herein amended. <br /> r. 1 <br /> 10 <br />
