• <br /> 8 <br /> insure that such coverage will survive the termination of this Agreement for at least three <br /> (3) years following the date of termination. <br /> A. Workers' Compensation Insurance as required by Washington law and <br /> Employer's Liability Insurance with limits of no less than $1,000,000 per <br /> occurrence. If sublet work is authorized by City, Premier Golf Centers, LLC shall <br /> require each subcontractor to provide Workers' Compensation Insurance for its <br /> employees, unless such employees are covered by Premier Golf Centers, LLC. <br /> Premier Golf Centers, LLC certifies that he/she is aware of the provisions of Title <br /> 51 of the Revised Code of Washington, which requires every employer to be <br /> insured against liability of Workers' compensation, or to undertake self-insurance <br /> in accordance with the provisions of that Title. Premier Golf Centers, LLC shall <br /> comply with the provisions of Title 51 of the Revised Code of Washington before <br /> commencing the performance of the work under this Agreement. Premier Golf <br /> Centers, LLC shall provide the City with evidence of Workers' Compensation <br /> Insurance(or evidence of qualified self-insurance)before any work is commenced <br /> under this Agreement. <br /> B. Commercial General Liability Insurance on an occurrence basis in an amount no <br /> less than $2,000,000 per occurrence and at least $2,000,000 in the annual <br /> aggregate, including but not limited to facilities and operations (including off-site <br /> operations), blanket contractual liability, broad form property damage, and liquor <br /> liability. This policy will apply on a primary basis. Premier Golf Centers, LLC's <br /> Commercial General Liability Insurance policy shall name the City of Everett, its <br /> officers, employees and agents as Additional Insured's with respect to the <br /> operations performed under this Agreement. Prior to any work being performed <br /> under this Agreement, Premier Golf Centers, LLC shall provide the City with a <br /> Certificate of Insurance acceptable to the City Attorney. Receipt by the City of <br /> any certificate showing less coverage than required is not a waiver of Premier <br /> Golf Centers, LLC's obligation to fulfill the requirements. <br /> C. Business Automobile Liability Insurance in an amount no less than $1,000,000 <br /> per occurrence, extending to any automobile. A statement certifying that no <br /> vehicle will be used in accomplishing this Agreement may be substituted for the <br /> insurance requirement. <br /> D. Fidelity Insurance for $100,000 covering all employees and officers having access <br /> to moneys collected. All employees of Premier Golf Centers, LLC who have <br /> access to or are responsible for the funds generated under this Agreement shall be <br /> bonded by a fidelity bond. Premier Golf Centers, LLC shall be responsible for any <br /> losses attributable to its officers and employees that are not covered by insurance <br /> and/or fidelity bonds. <br /> E. Property Insurance in the amounts deemed sufficient by the City of Everett Risk <br /> Management Department. <br /> No cancellation provision of any insurance policy shall be construed in derogation of the <br /> continuous duty of Premier Golf Centers, LLC to furnish the required insurance during <br /> 7 the term of this Agreement. <br /> 3 <br />
