5. The establishment of the proposed M-1 zone and repeal of the existing concomitant <br /> agreement promote the best long term interests of the Everett community by maintaining <br /> the property for industrial use and establishing more predictability for future site users <br /> and neighbors of the site. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The 40 acre parcel located on the west side of 36th Avenue West, north of <br /> Seaway Boulevard, as depicted on the attached"Exhibit A,"the legal description for <br /> which is: <br /> The Southeast quarter of the Northwest quarter of Section 3, Township 28 North, <br /> Rage 4 East, W.M. <br /> Except portion deeded to City of Everett under recording n. 1872524. <br /> Together with that portion of the North 300 feet of the Southwest quarter of the <br /> Northeast quarter of Section 3, Township 28 North, Range 4 East, W.M., lying <br /> westerly of Sound Avenue and the plat of Bridle Park, according to the plat <br /> thereof recorded in volume 18 of plats, pages 16 and 17, records of Snohomish <br /> County, Washington. <br /> Situated in the County of Snohomish, Washington. <br /> is hereby rezoned from M-M with concomitant agreement M-1 (Office and Industrial <br /> Park) as indicated by the attached "Exhibit B." <br /> Section 2. Rezone Ordinance No. 888-82 is hereby repealed. <br /> Section 3. The concomitant agreement to Rezone Ordinance No. 888-82 is hereby <br /> repealed. The mayor is hereby authorized to execute any documents necessary to void <br /> the concomitant agreement. <br /> Section 4. The City Clerk is hereby instructed to file the duly certified copy of this <br /> Ordinance with the Auditor of Snohomish County, Washington. <br /> Section 5. That should any section, subsection, paragraph, sentence clause or phrase set <br /> forth in this ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or situation. <br /> The City Council of the City of Everett hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br />
