• <br /> service be less than the amount charged for service connections within the City <br /> limits. <br /> 4. Delinquent Penalty and Special Charges. The delinquent penalty charge as set <br /> forth in Paragraph 8 of Section 2 plus a surcharge of twenty-five percent and the <br /> special charges as set forth in Paragraph 9 of Section 2 plus a surcharge of fifty <br /> percent, shall apply to customers outside the City limits. <br /> Section 3: State Utility Tax. The Mayor is authorized to increase or decrease the <br /> water charges herein to reflect any change in the State of Washington tax on water system <br /> revenues (currently set at 5.029% of system revenues). <br /> Section 4: On April 1, 1998, and thereafter on a biannual basis, the Utilities <br /> Superintendent shall submit a review and report of the financial condition of the water utility and <br /> City Council shall consider adjustment of rates, based on then current costs including but not <br /> limited to changes in the AFSCME Labor Relations agreement wage provisions for the position of <br /> Utility Laborer. <br /> Section 5: Domestic water customers will be defined as follows: "All metered water <br /> customers, either single family homes or multi-unit dwellings, of which the primary use is that of a <br /> structure to house human residents for an extended period of time shall be considered residential <br /> customers for the purpose of water billing." <br /> Section 6: Irrigation water customers will be defined as follows: "All metered water <br /> services which provide water solely for the purpose of commercial or agricultural irrigation of <br /> crops or landscaping shall be considered irrigation accounts for the purpose of water billing." <br /> Section 7: Future Rate Increases. Future increases in the rates charged herein <br /> (except the State of Washington tax on system revenues) may be increased by City Council <br /> resolution subject to public hearing and notice by publication thereof at least two weeks in <br /> advance of approval of said resolution. <br /> Section 8: Severability. If any section, sentence, clause or phrase of this ordinance <br /> should be held to be invalid or unconstitutional by a court of competent jurisdiction, such <br /> invalidity or unconstitutionality shall not affect the validity or constitutionality of any other <br /> section, sentence, clause or phrase of this ordinance. <br /> CSTAGORD:97WrRORD(Y1 6/5/97) 6 <br />
