• <br /> • <br /> ORDINANCE NO.cq,.,/ag-97 <br /> AN ORDINANCE relating to municipal judges, amending Sections 3, 4, 6, 7 and 8 of <br /> Ordinance No. 1259-86 (Chapter 2.108 EMC). <br /> WHEREAS, Everett is a city with a population of 400,000 or less which is operating a <br /> municipal court under the terms of Chapter 3.50 RCW and a charter adopted under the <br /> terms of RCW 35.22.030; and <br /> WHEREAS, RCW 3.50.055 requires that, in a city with judicial positions that are in <br /> combination more than one-half of a full-time equivalent position, the positions be filled <br /> by election; and <br /> WHEREAS, the current municipal court judge and additional judge appointed pursuant to <br /> Ordinance No. 1259-86 are in combination more than one-half of a full-time equivalent <br /> position; and <br /> WHEREAS,pursuant to the express grant of authority in RCW 3.50.050 to cities to set <br /> the qualifications for their municipal court judges the City of Everett is providing herein <br /> for the qualifications of its municipal judges; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance No. 1259-86, Section 3, (EMC 2.108.030)which currently reads as <br /> follows: <br /> Judge-Appointment-Qualifications. <br /> A. The municipal judge shall be appointed by the mayor within thirty <br /> days after the effective date of the ordinance codified in this chapter for a <br /> term of four years, which term pursuant to RCW 3.50.040 shall have <br /> commenced on January 1, 1986. Appointments for each term thereafter <br /> shall be made on or before December 1st of the year next preceding <br /> January 1st of the year in which the next term commences. Said <br /> appointment shall be subject to confirmation by city council. Preliminary <br /> to said confirmation, a judicial candidate review panel shall be appointed <br /> consisting of one member appointed by the mayor and one member <br /> appointed by a majority of the city council. Said two members shall <br /> appoint a third member to constitute a three member panel which shall <br /> review the background and qualifications of all judicial candidates and <br /> submit to the mayor the names of three candidates, from which list the <br /> mayor shall appoint the municipal judge; provided that the mayor's <br /> 1 <br />
