The City, including the <br /> examiner, retains continuing jurisdiction to address repeat <br /> violations in accordance with the provisions of this Chapter. <br /> C. Emergency. <br /> An "emergency" means a situation which in the opinion of the <br /> City' s code compliance officer (s) requires immediate action to <br /> prevent or eliminate an immediate threat to the health or safety <br /> of persons or property. Notwithstanding any provision in this <br /> Chapter, when a notice of violation is issued in the case of an <br /> emergency, immediate action shall be required by the person (s) to <br /> whom the notice of violation is issued. No action shall be <br /> stayed pending the filing of an appeal. If the City does not <br /> obtain immediate action by the responsible person upon issuance <br /> of the notice of violation, the City is authorized to immediately <br /> abate the violation itself or as otherwise provided herein. <br /> Notwithstanding the exercise of emergency authority, the City is <br /> entitled to collect its cost of abatement, assess penalties and <br /> take all actions provided in this Chapter. <br /> Section 7 : Repealer. <br /> Sections 3, 4, 5, and 6 of Ordinance No. 1554-89 (Sections <br /> 8 .20. 030, 8 .20 . 040, 8 .20 . 050 and 8 .20. 060 EMC) are hereby <br /> repealed. <br /> Section 8: Savings . <br /> Nothing contained herein shall be construed as abating any action <br /> now pending under or by virtue of any ordinance of the City; or <br /> as discontinuing, abating, modifying or altering any penalty <br /> accrued or to accrue, or as affecting the right or liability of <br /> any person, firm or corporation, or as waiving any right of the <br /> City under any ordinance or provision thereof in force at the <br /> time of passage of this ordinance. <br /> Section 9: Validity. <br /> Should any section, subsection„ paragraph, sentence, clause or <br /> phrase of this ordinance or its application to any person or <br /> situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining <br /> portions of this ordinance or its application to any other person <br /> or situation. The City Council hereby declares that it would <br /> have adopted this ordinance and each section, subsection, <br /> sentence, clause, phrase or port thereof irrespective of the fact <br /> 16 <br />
