• <br /> • <br /> This notice shall be submitted to the Violations Hearing Examiner <br /> on (date and time) at a CEASE AND DESIST <br /> ORDER and/or an ABATEMENT ORDER relating to the above offense. If <br /> you dispute the above action in any way, you should appear at <br /> that time. Failure to appear may result in entry of a CEASE AND <br /> DESIST ORDER, violation of which is a misdemeanor punishable by a <br /> fine of not to exceed $1, 000 per day. <br /> be and the same is hereby amended to read as follows: <br /> Notice of violation-Issuance - Appeal - Voluntary Correction <br /> Agreement. <br /> A. The City' s code compliance officer (s) are authorized to issue <br /> and serve a notice of violation upon reasonable cause to believe <br /> that a violation has occurred of the ordinances set forth in <br /> Section 1 .20. 020 or such other ordinances that identify the <br /> herein described enforcement procedure as the enforcement <br /> procedure for said ordinances . For purposes of this chapter, a <br /> "code compliance officer" is a City employee or employees <br /> designated by the Mayor to implement the enforcement provisions <br /> provided herein. The notice shall be issued to the property <br /> owner, landlord and/or to any person causing, allowing or <br /> participating in the violation. Additionally, a copy of such <br /> notice or a summary thereof may be sent to the mortgage holder, <br /> landlord or anyone else who may have an interest in the property. <br /> The notice of violation shall be served by means of personal <br /> delivery, sending certified mail return receipt requested or by <br /> posting the subject property with the notice of violation. Such <br /> notice of violation shall include substantially the following: <br /> 1 . The name and address of the person to whom the notice is <br /> issued; and <br /> 2 . The location of the subject property by address or other <br /> description sufficient for identification of the subject <br /> property; and <br /> 3 . The regulation that has been violated; and <br /> 4 . A description of the violation and corrective action to <br /> be taken; and <br /> 5. A statement that a monetary penalty in an amount per day <br /> is assessed against the person to whom the notice is <br /> issued for each and every day or portion of a day during <br /> which the violation continues; and <br /> 6. The date by which compliance is required to avoid <br /> monetary penalty and/or abatement by the City; and <br /> 7 . A statement that the person to whom the notice is <br /> issued must correct the violation and pay to the City any <br /> 2 <br />
