• <br /> upon the concurrence of the city attorney, files for injunctive <br /> or other civil relief in superior court. <br /> Section 3: Section 3 of Ordinance No. 1383-87 as amended by <br /> section 2 of Ordinance No . 1780-91 (EMC 1 .20. 030) which reads as <br /> follows : <br /> Notice of violations-Violations hearing examiner review-Cease and <br /> desist order issuance. <br /> All notice of violations issued by staff shall be submitted to <br /> the violations hearing examiner, as established under Section <br /> 1 .20. 040, who shall inquire as to the validity of the violation. <br /> Such notice may be amended by city staff in the courts of <br /> contested proceedings . If the violations hearing examiner finds <br /> that the violation exists substantially as stated by city staff, <br /> the violations hearing examiner shall issue a cease and desist <br /> order in a form consistent with his or her findings . The cease <br /> and desist order may also contain a requirement that the <br /> violation be abated in the manner prescribed by the violations <br /> hearing examiner. <br /> be and the same is hereby repealed. <br /> Section 4 : Section 4 of Ordinance No. 1383-87 as amended by <br /> Section 3 of Ordinance No. 1780-91 (EMC 1 .20. 040) which reads as <br /> follows : <br /> 1 . 20 . 040 Violations hearing examiner-Powers and duties . <br /> A. There is created the office of violations hearing examiner. <br /> B. The violations hearing examiner (s) shall be part-time and <br /> remunerated by personal service contract. <br /> C. The violations hearing examiner (s) shall be appointed by the <br /> mayor. <br /> D. The violations hearing examiner (s) shall be licensed to <br /> practice law in the state. <br /> E. The violations hearing examiner will be responsible for <br /> presiding over all hearings on notices of violations as well as <br /> other additional administrative matters over which he/she may be <br /> requested to preside. <br /> F. The violations hearing examiner shall have the power to: <br /> 1 . Administer oaths and affirmations, examine witnesses and <br /> receive evidence; <br /> 2 . Issue subpoenas upon the request of any party. The city <br /> treasurer, his designated agent, the city attorney and any <br /> officer authorized to enforce this chapter are also authorized to <br /> issue subpoenas .
