8. The City Council did hold a public hearing on the moratorium on May 8, 1996, <br /> amended the moratorium by the adoption of Ordinance No. 2145-96 and <br /> adopted findings and conclusions in Resolution No. 4264 and extended the <br /> moratorium for an additional six (6) month period following a public hearing <br /> through the adoption of Ordinance No. 2173-96 and the implementation of a <br /> work plan; and <br /> 9. The extension to the moratorium provided in this ordinance does not in any way <br /> repeal or modify Ordinance No. 2145-96; and <br /> 10. The City Council did hold a public hearing on March 19, 1997, to consider <br /> extending the moratorium for an additional six month renewal period; and. <br /> 11. The moratorium will terminate unless extended by the adoption of this ordinance <br /> further amending Ordinance No. 2138-96; and <br /> 12. An additional extension of the moratorium would allow the City to continue to <br /> implement the work plan by monitoring on-going litigation and defending its <br /> ordinances concerning the City's adult use policy and regulatory strategy. The <br /> moratorium, Ordinance No. 2138-96 as amended, was adopted on April 12, <br /> 1996, for a six month period through October 12, 1996, unless extended for one <br /> or more six month renewal periods. Through the adoption of Ordinance No. <br /> 2173-96, the City amended Ordinance No. 2138-96 to provide for an additional <br /> six month renewal period thereby extending Ordinance No. 2138-96 through <br /> April 12, 1997. This second six month renewal period provided by this <br /> ordinance further extends Ordinance No. 2138-96 for an additional six months <br /> through October 12, 1997, without any lapse; and <br /> WHEREAS,the City Council does conclude: <br /> The moratorium concerning the licensing and the siting of adult use businesses <br /> must be extended for a second six(6) month renewal period through October <br /> 12, 1997, to act as a stop-gap measure since the City's zoning and comprehensive <br /> plan related to adult use businesses are being challenged which challenges could <br /> adversely effect the City's policy and regulatory strategy for adult use businesses <br /> and to allow the City to continue to monitor and defend the challenges to its <br /> adult use policy and regulatory strategy; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance No. 2138-96, as amended, was originally adopted on April <br /> 12, 1996, for a six month period. Through the adoption of Ordinance No. 2173-96, <br /> Ordinance No. 2138-96 was extended for an initial six month renewal period and the City <br /> provided for subsequent six month renewal periods by later adoption. Ordinance No. 2138- <br /> 96, as amended by Ordinance No. 2145-96 and Ordinance No. 2173-96, is hereby amended <br /> 2 <br />
