• <br /> improvements at the water pollution control facility for the System, and in the sewer collection <br /> system including filters, scrubbers and chemical additions; (2) capital design, engineering work <br /> and the construction of upgrades to the water pollution control facility; (3) replacement of the <br /> force main downstream from Lift Station No. 4; and (4) replacement of sanitary sewers. <br /> All improvements to the System described above are hereinafter referred to collectively as <br /> the "Project." The City shall provide all equipment, connections and appurtenances together with <br /> all work incidental and necessary to complete the Project. The City may make such changes in or <br /> additions to the Project or in the construction or design of other facilities of the System as may be <br /> found necessary or desirable. The City shall acquire by purchase, lease or condemnation all <br /> property, real or personal, or any interest therein, or rights-of-way and easements that may be <br /> necessary to acquire, construct and install the Project. <br /> The estimated cost of this plan of additions, betterments and improvements, and all costs <br /> incidental thereto, is hereby declared to be as nearly as practicable $11,440,000, of which <br /> approximately $6,000,000 is to be provided out of the proceeds of the Bonds. The Council <br /> hereby finds that it is in the best interests of the City and the users of the System that the City <br /> issue the Bonds to pay such portion of the costs of the Project, and to pay the costs incident to <br /> the issuance of the Bonds. <br /> Section 3. Findings of Parity. The City hereby finds and determines as required by <br /> Section 16 of Ordinance No. 1433-88, Section 16 of Ordinance No. 1891-92, and Section 14 of <br /> Ordinance No. 1963-93 and in accordance with Section VII.B, as amended, of the SRF Loan, as <br /> follows: <br /> That the Bonds shall be issued for the purpose of providing funds to make capital <br /> improvements to the System; <br /> That at the time of issuance of the Bonds, the City shall have on file (i) a certificate from <br /> the Finance Director showing that there is no deficiency in the Revenue Bond Fund or any <br /> accounts therein and (ii) a certificate from an independent professional engineer as required by <br /> -10- FWWOBU.DOC 97/03/04 <br />
