• • ORDINANCE NO. 2207-97 An Ordinance Rezoning the Chaplain Property Located in the Sultan Basin from R-S (Suburban Residential) to WRM(Watershed - Resource Management). WHEREAS, the City of Everett owns and manages the Chaplain property in the Sultan River basin for the purpose of providing a municipal water supply for the City of Everett and other areas is Snohomish County; and WHEREAS, the City has annexed this property and therefore has the responsibility for regulating the use of land within this area of approximately 3,100 acres; and WHEREAS, portions of the City-owned Chaplain Reservoir land are managed under Federal Energy Regulatory Commission License#2157 regulating the Henry M. Jackson Hydroelectric Project, conditioned by the implementation of the Wildlife Habitat Management Plan to mitigate for wildlife habitat losses caused by inundation of land at Spada Reservoir; and WHEREAS, the Chaplain property zoning of R-S (Suburban Residential)was established upon annexation because the City did not have a land use zoning classification which provided for the intended use of the property; and WHEREAS, the Everett Comprehensive Plan has designated the Chaplain property"watershed- resource management" and includes policies calling for the establishment of a new zoning classification to be applied to the Chaplain property that provides for the provision of a safe and adequate water supply as the primary purpose for the new zoning classification; and WHEREAS,the Planning Commission conducted a public hearing on January 7, 1997 to consider the addition of a new zoning classification entitled"Watershed - Resource Management"to the City of Everett Zoning Code and recommended that the City Council approve the new zoning classification as an amendment to the Zoning Code; and WHEREAS, the City Council conducted a public hearing on February 26, 1997 to consider the recommendation of the Planning Commission; and WHEREAS, the City Council finds: 1. The proposed rezoning of the Chaplain Tract to Watershed - Resource Management is consistent with and implements the Everett Comprehensive Plan policies for resource lands. 2. The proposed rezoning of the Chaplain Tract to Watershed- Resource Management bears a substantial relationship to public health, safety and welfare. 1
