Section 2. Section 30.030.A of Ordinance #1671-89, which reads:
<br /> A. Permitted Uses. The following uses have a low flood danger potential and if not
<br /> obstructing flood flows, shall be permitted within the floodway district, provided they are
<br /> not prohibited by any other ordinance and provided they do not require permanent
<br /> structures, fill or storage of materials or equipment, and meet the requirements of Federal
<br /> Regulations, 44 CFR, Part 60.3 and Section 30.050 of this title:
<br /> 1. Agricultural uses such as general farming,pasture, grazing, outdoor plant nurseries,
<br /> horticulture,truck farming, forestry, sod farming and wild-crop harvesting;
<br /> 2. Residential uses such as lawn, gardens,parking areas and play areas;
<br /> 3. Private and public recreational uses such as golf courses,tennis courts, driving ranges,
<br /> archery ranges, picnic grounds, boat-launching ramps,parks, wildlife and nature
<br /> preserves, game farms, fish hatcheries, shooting preserves, target ranges,trap and skeet
<br /> ranges, hiking and riding trails; and
<br /> 4. Municipal facilities.
<br /> is hereby amended to read:

<br /> target ranges, trap and skeet ranges, hiking and riding trails; and
<br /> 4. Municipal facilities.
<br /> Section 1 That should any section, subsection,paragraph, sentence clause or phrase set
<br /> forth in this ordinance or its application to any person or situation be declared
<br /> unconstitutional or invalid for any reason, such decision shall not affect the validity of the
<br /> remaining portions of this ordinance or its application to any other person or situation.
<br /> The City Council of the City of Everett hereby declares that it would have adopted this
<br /> ordinance and each section, subsection, sentence, clause,phrase or portion thereof
<br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses,
<br /> phrases or portions be declared invalid or unconstitutional.
<br /> Section 4. It is expressly the purpose of this ordinance to provide for and promote the
<br /> health, safety and welfare of the general public and not to create or otherwise establish or
<br /> designate any particular class or group of persons who will or should be especially
<br /> protected or benefited by the terms of this ordinance.
