ORDINANCE NO. 2204-97 <br /> An Ordinance Amending and Finalizing the Emergency Measure of the <br /> Adult Use Business Zoning Regulations and Making the Regulations Permanent, <br /> Amending Ordinance No. 2144-96, Repealing Section 18 of Ordinance No. 2144-96 <br /> and Repealing Sections 1 and 2 of Ordinance No. 2178-96. <br /> WHEREAS,the City of Everett since 1986 has provided for reasonable alternative <br /> locations for adult use businesses through its zoning regulations and comprehensive plan <br /> policies which locations are primarily in Southwest Everett and certain other commercial <br /> and industrial zones subject to additional locational requirements; and <br /> WHEREAS, Judge Farris' decision in Wallock v. City of Everett prompted a need to <br /> modify the City's Zoning Code; and <br /> WHEREAS,the City Council, following public hearings before the Planning <br /> Commission and City Council, adopted on an emergency basis Zoning Code provisions <br /> for adult use businesses on May 8, 1996, for a six-month period; and <br /> WHEREAS, the City Council, following public hearings before the Planning <br /> Commission and City Council, extended the emergency Zoning Code provisions for <br /> adult use businesses an additional six months to allow for the further study of the issue <br /> including the review of technical issues raised before the Growth Hearings Board, and to <br /> allow for additional public participation in the development of final comprehensive plan <br /> policies for adult use businesses; and <br /> WHEREAS, an environmental analysis of the Zoning Code amendments has been <br /> conducted by the City in compliance with the requirements of the State Environmental <br /> Policy Act(SEPA); and <br /> WHEREAS, the City of Everett has encouraged public participation in the consideration <br /> of amendments to the Comprehensive Plan and Zoning Code, as required by the Growth <br /> Management Act,through a variety of notification procedures, including SEPA review, <br /> mailing to interested citizens and organizations, legal publication, and the City of Everett <br /> cable television bulletin board,public workshops and public hearings; and <br /> WHEREAS,the Planning Commission conducted a public workshop on December 17, <br /> 1996, and a public hearing on January 21, 1997,to consider the proposed amendments to <br /> the Land Use Element policies of the Comprehensive Plan and Zoning Code regulations <br /> related to adult use businesses, and has made recommendations to the City Council; and <br /> 1 <br />
