WHEREAS, amending comprehensive plans and development regulations under the <br /> Growth Management Act is a comparatively new process; and <br /> WHEREAS, the previous litigation has raised procedural as well as substantive legal <br /> challenges to the City's actions; and <br /> WHEREAS,the pending and potential litigation if successful even on procedural grounds <br /> would threaten the City's ability to manage the secondary adverse impacts of adult use <br /> businesses; and <br /> WHEREAS, the continued threat to the City's adult use business policies and regulations <br /> creates a risk to the City's ability to manage the averse secondary impacts from such <br /> businesses; and <br /> WHEREAS, the City Council finds this risk to constitute an emergency; and <br /> WHEREAS,the City Council does hereby find that by the adoption of this Ordinance the <br /> City Council finalizes the emergency measures concerning adult use business zoning <br /> regulations adopted in Ordinance No. 2144-96 and makes them permanent; <br /> Now, Therefore, The City of Everett Does Ordain: <br /> Section 1. The title to Ordinance No. 2144-96 which reads as follows: <br /> An Ordinance Amending City of Everett Zoning Code Ordinance#1671-89, as <br /> amended, Related to Adult Use Businesses, Providing an Interim Designation, and <br /> Declaring an Emergency to Exist. <br /> be and the same is hereby amended to read as follows: <br /> An Ordinance Amending City of Everett Zoning Code Ordinance#1671-89, as <br /> amended, Related to Adult Use Businesses, and Declaring an Emergency to Exist. <br /> Section 2. Section 18 of Ordinance No. 2144-96 is repealed and Sections 1 and 2 of <br /> Ordinance No. 2178-96 are hereby repealed. The remaining provisions of Ordinance No. <br /> 2144-96 and 2178-96 as amended herein are hereby made permanent. <br /> Section 3. An emergency does exist and this is a continuation of the emergency action <br /> commenced in Ordinance No. 2144-96 <br /> 3 <br />
