• <br /> • <br /> while maintaining minimum separation requirements between adult use businesses and <br /> their adverse secondary impacts and sensitive land uses in the City; <br /> 3. The proposed amendments to the Land Use Element policies related to adult use <br /> businesses are consistent with other policies of the Comprehensive Plan, including the <br /> policies for land use, economic development, promotion of job growth in industrial areas, <br /> employment densities supportive of efficient transportation infrastructure, preservation of <br /> neighborhood character, and providing for the commercial service needs of Everett and <br /> surrounding areas in Snohomish County; <br /> WHEREAS, proponents of adult use businesses have challenged the City's adult use ordinances <br /> before the Central Puget Sound Growth Management Hearings Board and in State and Federal <br /> Court; and <br /> WHEREAS, amending comprehensive plans and development regulations under the Growth <br /> Management Act is a comparatively new process; and <br /> WHEREAS, the previous litigation has raised procedural as well as substantive legal challenges <br /> to the City's actions; and <br /> WHEREAS, the pending and potential litigation if successful even on procedural grounds would <br /> threaten the City's ability to manage the secondary adverse impacts of adult use businesses; and <br /> WHEREAS, the continued threat to the City's adult use business policies and regulations creates <br /> a risk to the City's ability to manage the averse secondary impacts from such businesses; and <br /> WHEREAS,the City Council finds this risk to constitute an emergency; <br /> Now, Therefore, The City of Everett Does Ordain: <br /> Section 1. The title of Ordinance No. 2143-96 which reads as follows: <br /> An Ordinance Amending Exhibit A of Ordinance#2021-94,the City of Everett <br /> Comprehensive Plan, and in particular,the Land Use Element Policies as they <br /> Relate to Adult Use Businesses, Providing an Interim Designation, and Declaring <br /> an Emergency to Exist. <br /> be and the same is hereby amended to read as follows: <br /> An Ordinance Amending Exhibit A of Ordinance#2021-94,the City of Everett <br /> Comprehensive Plan, and in particular,the Land Use Element Policies as they <br /> Relate to Adult Use Businesses, and Declaring an Emergency to Exist. <br /> Section 2. Section 2 of Ordinance No. 2143-96, which reads as follows: <br /> 1.3.11 Adult use businesses, as defined by the Zoning Code are considered compatible with all <br /> of the industrial land use designations as designated on the Land Use Map,provided that <br /> they meet the locational criteria of the Zoning Code.
