Conversion of the industrial land base to non-industrial use is <br /> discouraged, except under limited circumstances where it can be demonstrated by <br /> the property owner that industrial use of a site is not feasible and that conversion <br /> to a non-industrial use will not reduce the viability of adjoining industrial lands. <br /> The use of industrially zoned land in Southwest Everett for adult use businesses <br /> shall not be deemed to be a conversion of the industrial land base to a non- <br /> industrial use, and adult use businesses shall be deemed to be compatible with and <br /> permitted in the industrial land use designations, provided they comply with the <br /> locational requirements of the Zoning Code. Non-industrial land uses which are <br /> specifically permitted in industrial zones by the Zoning Code shall be permitted as <br /> provided by the Zoning Code. Such non-industrial uses are considered <br /> compatible with the Southwest Everett industrial land use designations of the <br /> Comprehensive Plan. If the provision allowing adult use businesses and other <br /> non-industrial uses in industrial areas, as regulated by the Zoning Code, is <br /> inconsistent with any other policy in the Comprehensive Plan or with any other <br /> provision of this policy, then the provision allowing adult use businesses and <br /> other non-industrial uses in industrial areas, as regulated by the Zoning Code, <br /> shall control. <br /> Section 4. Section 6 of Ordinance No. 2143-96 is repealed and Sections 1 and 2 of Ordinance <br /> No. 2177-96 are repealed. The remaining provisions of Ordinance No. 2143-96 and 2177-96 as <br /> amended herein are hereby made permanent. <br /> Section 5. An emergency does exist and this ordinance is deemed to be a continuation of the <br /> emergency action commenced in Ordinance No. 2143-96. <br /> Section 6. That should any section, subsection, paragraph, sentence clause or phrase set forth in <br /> this ordinance or its application to any person or situation be declared unconstitutional or invalid <br /> for any reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City of <br /> Everett hereby declares that it would have adopted this ordinance and each section, subsection, <br /> sentence, clause,phrase or portion thereof irr,4 ective of the fact that any one or more sections, <br /> subsections, sentences, clauses,phrases or .• ions be declared invalid or unconstitutional. <br /> )/.
