• <br /> Section 2: <br /> Where a non-residential metered water customer can demonstrate that its consumption of water is <br /> now and will be substantially in excess of surface water impact, the Public Works Director is <br /> authorized to adjust the charges for water quality protection and enhancement to adequately <br /> reflect any excessive disparity. The burden of proof shall be on the applicant for any adjustment <br /> and adjustment shall not be retroactive. The Public Works Director shall develop criteria and <br /> procedures for such review. <br /> Section 3: <br /> The City of Everett will review the user charges at least biennially and revise the rates as <br /> necessary to ensure that adequate revenues are generated to pay the costs of operation and <br /> maintenance including replacement and that the system continues to provide for proportional <br /> distribution of costs of operation and maintenance including replacement among users. <br /> Section 4: <br /> This ordinance shall be effective 1/1/97 <br /> 4,i <br /> EDW• ' D.
