• <br /> Section 3: Section 3 of Ordinance 1041-84, as amended by section 1 of Ordinance <br /> 1146-85 (EMC 16.60.090), which reads as follows: <br /> Discharge of special fireworks. <br /> No person may discharge special fireworks at any place except as authorized by <br /> state license and local permit for a public display of fireworks; provided, that <br /> common fireworks, firecrackers, salutes and chasers may be purchased and used by <br /> religious organizations or private organizations or persons if purchased from a <br /> licensed manufacturer, importer, or wholesaler for use on prescribed dates and <br /> locations, for religious or specific purposes, upon obtaining a permit therefor from <br /> the city fire marshal. <br /> is hereby amended to read as follows: <br /> Discharge of fireworks prohibited. <br /> No person may discharge fireworks at any place except as authorized by state <br /> license and local permit for a public display of fireworks; provided, that common <br /> fireworks, firecrackers, salutes and chasers may be purchased and used by religious <br /> organizations or private organizations or persons if purchased from a licensed <br /> manufacturer, importer, or wholesaler for use on prescribed dates and locations, for <br /> religious or specific purposes, upon obtaining a permit therefor from the city fire <br /> marshal. Violation of this section is a gross misdemeanor. <br /> Section 4: Section 13 of Ordinance No. 1041-84 (EMC 16.60.140), which reads as <br /> follows: <br /> It is unlawful to possess special fireworks or any other class or kind of fireworks in <br /> violation of RCW Chapter 70.77. A violation of this section is: <br /> A. A misdemeanor if involving less than one pound of fireworks, exclusive of <br /> external packaging; or <br /> B. A gross misdemeanor if involving one pound or more of fireworks, exclusive of <br /> external packaging. <br /> is hereby amended to read as follows: <br /> Unless otherwise allowed by permit granted under the provisions of this chapter, it <br /> is unlawful to possess any class or kind of fireworks-within the city limits of Everett. <br /> A violation of this section is: <br /> A. A misdemeanor if involving less than one pound of fireworks, exclusive of <br /> external packaging; or <br /> B.
