• <br /> Section 5: Repealer <br /> The following sections are hereby repealed: <br /> A. Section 1 of Ordinance No. 1792-91, as amended by section 1 of Ordinance No. <br /> 2101-95 (EMC 16.60.110 - Hours of sale.) <br /> B. Section 2 of Ordinance No. 1792-91 (EMC 16.60.112 - Prohibited fireworks.) <br /> C. Section 3 of Ordinance No. 1792-91, as amended by Ordinance No. 2101-95 <br /> (EMC 16.60.114 -Hours of discharge.) <br /> D. Section 4 of Ordinance No. 1792-91 (EMC 16.60.116 - Discharge of aerial <br /> devices-Prohibited.) <br /> E. Section 5 of Ordinance No. 1792-91 (EMC 16.60.118 - Sale to minors.) <br /> F. Section 2 of Ordinance No. 1041-84 (EMC 16.60.120 - Sale-Posting of list of <br /> saleable fireworks.) <br /> G. Section 14 of Ordinance No. 1041-84, as amended by section 4 of Ordinance No. <br /> 1146-85 (EMC 16.60.150 - Violation-Unlawful sale of fireworks.) <br /> H. Section 15 of Ordinance No. 1041-84 (EMC 16.60.160 - Violation-Unlawful <br /> discharge of fireworks.) <br /> Section 6: Effective Date. <br /> Pursuant to RCW 70.77.250(4), the provisions of this ordinance shall become effective <br /> one year from the date of adoption of this ordinance. <br /> Section 7: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or <br /> its application to any person or situation be declared unconstitutional or invalid for any <br /> reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City <br /> of Everett hereby declares that it would have adopted this ordinance and each section, <br /> subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one <br /> or more sections, subsections, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> Section Third Party Liability <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety <br /> and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or <br /> benefited by the terms of this ordinance. <br /> It is the specific intent of this ordinance that no provisions nor any term used in this <br /> ordinance is intended to impose any duty whatsoever upon the City or any of its officers <br /> or employees, for whom the implementation and enforcement of this ordinance shall be <br /> discretionary and not mandatory. <br /> ORDINANCE PROHIBITING FIREWORKS <br /> Page 3 <br />
