<br /> 3. As necessary for the project, the City has the right to move, set aside, or displace the
<br /> Grantor's personal property that restricts or hampers the purpose of this agreement, over,
<br /> under and upon the lands of the Grantor. Any such personal property that the City relocates
<br /> shall be promptly restored to its original location without damage to the Property or the
<br /> personal property.
<br /> 4. The City will protect and hold harmless, Grantor, its authorized agents and employees from
<br /> all claims, actions, costs, damages or expenses of any nature whatsoever by reason of the acts
<br /> or omissions of the City, its assigns, agents, contractors, licensees, invitees, or employees,
<br /> arising out of or in connection with any acts or activities authorized by this Agreement. The
<br /> City further agrees to defend Grantor, its agents or employees in any litigation, including
<br /> payment of any costs or attorneys' fees for any claims or action commenced, arising out of, or
<br /> in connection with, the City's acts or activities authorized by this Agreement, whether those
<br /> claims, actions, costs, damages or expenses result from acts or activities occurring on or off
<br /> the Property.
<br /> A. The obligations contained in this Section 4 shall not include such claims,
<br /> costs, damages, or expenses which may be caused by the sole negligence of Grantor or its
<br /> authorized agents or employees; Provided that, if the claims or damages are caused by or
<br /> result from the concurrent negligence of(a) Grantor, its agents or employees and (b) the City,
<br /> its agents or employees, or involves those actions covered by RCW 4.24.115, the indemnity
<br /> provisions of this Section 4 shall be valid and enforceable only to the extent of the
<br /> negligence of the City or the City's agents or employees.
<br /> B. Survival. Licensee's obligations and liabilities under this Section 4 shall
<br /> survive the expiration or earlier termination of this Agreement.
<br /> 5. Notwithstanding any other provision in this Agreement to the contrary, the City, at its sole
<br /> cost, shall comply with all applicable laws, statutes, ordinances,regulations, rules, and other
<br /> governmental requirements (hereinafter called "laws"), in performing or observing its
<br /> obligations under this Agreement. The provisions of this Section shall not supersede, but
<br /> shall be in addition to, any other provisions in this License, which impose a higher standard
<br /> of care or duty by Agreement.
<br /> 6 The City shall provide to Grantor, at not cost to Grantor, copies of any work product that it or
<br /> its agents generate relating to the Property. Work product as used herein refers, without
<br /> limitation, to any data, logs, surveying, engineering analysis or other information resulting
<br /> from the City's exercise of the rights under this Agreement.
