A <br /> F. MISCELLANEOUS PROVISIONS <br /> 1. The District reserves whatever rights it may have to withdraw from the current re- <br /> licensing process or to refuse to accept any new license that is offered by FERC <br /> or to appeal or challenge any provision thereof. The District's right to assign its <br /> rights under the 1960 and 1981 Agreements between the parties to another party <br /> are unaffected by this Supplemental Agreement and the provisions of Article VIII, <br /> Section 5, of the 1981 Agreement shall continue to apply to such assignment. <br /> 2. Except as otherwise set forth in this Supplemental Agreement or the 1960 and <br /> 1981 Agreements,the parties acknowledge that the execution of this <br /> Supplemental Agreement waives, releases and discharges any pending claims the <br /> parties may have against each other regarding the Project as of the date of this <br /> Supplemental Agreement. <br /> 3. No definition or use of any term used herein that is also used in either the 1960 or <br /> 1981 Agreements shall for purposes of either of those agreements be changed by <br /> its use herein. The provisions of this Supplemental Agreement are supplemental <br /> to the provisions of the 1960 Agreement and 1981 Agreement. Neither the 1960 <br /> Agreement nor the 1981 Agreement are amended by this Supplemental <br /> Agreement except by execution of the Addendum attached and appended to this <br /> Supplement Agreement as Exhibit 1. <br /> 4. The term of this Supplemental Agreement shall be for the same term that is set <br /> forth in Article VIII, Section 3, of the 1981 Agreement. <br /> 5.
