2007 STOP Violence Against Women Formula Grant <br /> Intergovernmental Agreement <br /> Violence Against Women. Grant funds are administered by the Office of Crime Victims <br /> Advocacy,Washington State Depai lment of Community,Trade and Economic <br /> Development." <br /> The Contractor agrees to submit to the Department one copy of all reports and proposed <br /> publications funded by this Agreement not less than thirty(30) days prior to public release, <br /> publication, or distribution for review by the Office on Violence Against Women, U.S. <br /> Department of Justice. <br /> 12. CONFIDENTIAL INFORMATION <br /> The Contractor shall not disclose or misuse any confidential information obtained under <br /> this Agreement unless the disclosure is authorized by law (and directly connected to the <br /> official purpose for which the information was obtained). <br /> 13. SAFEGUARDING OF CONFIDENTIAL INFORMATION <br /> The Contractor shall not use or disclose confidential information in any manner that <br /> would constitute a violation of federal law or applicable provisions of Washington State <br /> law. The Contractor agrees to comply with all federal and state laws and regulations, as <br /> currently enacted or revised, regarding data security and electronic data interchange of <br /> confidential information. <br /> The Contractor shall protect confidential information collected, used, or acquired in <br /> connection with this Agreement, against unauthorized use, disclosure, modification, or <br /> loss. The Contractor shall ensure its directors, officers, employees, subcontractors or <br /> agents use the confidential information solely for the purposes of accomplishing the <br /> services set forth in this Agreement. The Contractor agrees not to release, divulge, <br /> publish, transfer, sell, or otherwise make confidential information known to unauthorized <br /> persons without the express written consent of the affected party or as otherwise <br /> authorized by law. The Contractor agrees to implement safeguards to prevent <br /> unauthorized access, use, or disclosure of confidential information. The Contractor shall <br /> notify the Department immediately after becoming aware of any unauthorized access, <br /> use, or disclosure of confidential information and shall take necessary steps to mitigate <br /> the harmful effects of such use or disclosure. <br /> 14. INDEPENDENT CAPACITY <br /> The Contractor, its employees, agents, or subcontractors who are engaged in the <br /> performance of this Agreement shall continue to be employees or agents of the Contractor <br /> and shall not be considered for any purpose to be employees or agents of the Department. <br /> Each contract that the Contractor enters into with subcontractors, creditors, and others shall <br /> contain a clause providing notice that the State and the Department are not responsible for <br /> any legal obligation, financial or otherwise, incurred by the Contractor or subcontractors. <br /> 3 <br /> 15.
