F. Term of Agreement <br /> The term of this HOME Agreement begins on the date of the Agreement and expires on the <br /> November 21, 2032. <br /> G. Term for Expenditure of HOME Funds <br /> The Agency shall fully disburse the HOME funds provided under this Agreement for the Project <br /> in accordance with the terms hereof by December 31, 2007. <br /> H. Capitalized Terms <br /> All capitalized terms used but not defined herein shall have the meanings ascribed to them in <br /> 24 CFR Part 92. In addition, the meanings of capitalized terms defined herein are qualified in <br /> their entirety by reference to the definitions contained in 24 CFR Part 92. <br /> II. PROGRAM REQUIREMENTS <br /> A. Federal Requirements <br /> The applicable federal requirements set forth in 24 CFR § 92.250 through 92.258 shall apply to <br /> the Agency as a participant in the HOME Program and are incorporated herein. The applicable <br /> requirements include the maximum subsidy per unit; property standards, qualifications as <br /> affordable rental housing; tenant and participant protections; and religious organizations. <br /> In addition to the above, the applicable federal requirements set forth in 24 CFR § 92.350 <br /> through 92.357 shall apply to the Agency as a participant in the HOME Program and are <br /> incorporated herein. The applicable requirements include: nondiscrimination and equal <br /> opportunity; affirmative marketing and minority outreach; environmental review; displacement, <br /> relocation and acquisition; labor; lead based paint; conflict of interest; disclosure requirements; <br /> debarred, suspended or ineligible contractors; and drug free workplace. The Federal <br /> nondiscrimination requirements set forth at 42 U.S.C. § 12832 and relating to race, color, <br /> religion, ethnic or national origin, gender, sexual orientation, age and non-disqualifying <br /> handicaps also are applicable. <br /> B. Environmental Review <br /> 1. NEPA <br /> Pursuant to 24 CFR § 92.352(b)(1), the City retains responsibility for environmental review, <br /> decisionmaking and action for purposes of fulfilling requirements of the National <br /> Environmental Policy Act for each activity carried out with HOME funds. The City may <br /> require the Agency to furnish data, information, and assistance for its review and <br /> - 3 - <br /> 3 <br />
