• 4 UVJ v, ORDINANCE NO. 2154-96 AN ORDINANCE extending the interim traffic mitigation policy by amending Ordinance No. 1670-89, as amended by Ordinance No. 1833-91, 1910-92, 1967- 93, and 2112-95. WHEREAS, the City Council finds that on December 27, 1989, the City Council passed Ordinance No. 1670-89 establishing an interim traffic mitigation policy for the City of Everett; and WHEREAS, the City Council finds that Ordinance No. 1670-89 has been amended to extend the interim traffic mitigation policy until July 1, 1996; and WHEREAS, the City Council finds that the City continues working towards the development of a permanent traffic mitigation ordinance, and some additional work needs to be completed to bring the ordinance forward for Council's consideration; and WHEREAS, the City Council finds that the interim traffic mitigation policy should be extended to provide for this additional time; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: Section 18 of Ordinance No. 1670-89 as amended by Ordinance No. 1833-91, 1910-92, 1967-93 and 2112-95 reads as follows: The Council finds that this ordinance is necessary for the immediate preservation of the public peace, health, safety and the public welfare. This ordinance shall remain in effect until July 1, 1996. be and the same is hereby amended to read as follows: The Council finds that this ordinance is necessary for the immediate preservation of the public peace, health, safety and the public welfare. This ordinance shall remain in effect until December 31, 1996. SECTION 2: SEVERABILITY. Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional.
