• <br /> SECTION 9: THIRD PARTY LIABILITY <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety, <br /> and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be specially protected or benefited <br /> by the terms of this ordinance. <br /> Nothing contained in the ordinance is intended nor shall be construed to create or form the <br /> basis of any liability on the part of the City, or its officers, employees or agents, resulting <br /> from any action or inaction on the part of the City related in any manner to the <br /> enforcement of this ordinance by its officers, employees, or agents. <br /> SECTION 10: EMERGENCY CLAUSE - INTERIM PROCEDURAL REGULATIONS <br /> The City Council finds that the Act mandates the adoption of the regulations contained <br /> herein; that the regulations contained herein must be adopted by March 31, 1996, and <br /> effective April 1, 1996; that the City's failure to comply with these time frames would <br /> create confusion in the administration of the City's land use regulations, would be contrary <br /> to State law and expose the City to potential liability; and that the regulations contained <br /> herein are procedural regulations. The City Council does hereby conclude that this <br /> ordinance is necessary for the immediate preservation of the public peace, health and <br /> safety. The City Council declares that an emergency exists, and that this ordinance shall <br /> take effect immediately. The City Council further declares that this ordinance shall be <br /> interim. City ordinances affected by this ordinance shall be reviewed and amendment <br /> prepared to bring said ordinances into compliance with the provisions of this ordinance <br /> and the Act and brought forward for Council's consideration no later than one year from <br /> the effective date of this ordinance. <br /> SECTION 11: SEVERABILITY <br /> If any section, sentence, clause or phrase or this ordinance should be held to be invalid or <br /> unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality <br /> shall not affect the validity or constitutionality of any other section, sentence, clause or <br /> phrase of this ordinance. <br /> C(a <br /> G, /J <br /> . - .n -n, Mayor <br /> ATTEST: — <br /> City Clerk <br /> Interim Administrative Procedures Ordinance 20 <br /> ESHB 1724 <br />
