Exhibit "1" Addendum to Concomitant Agreement to Ordinance No. 790-81 THIS Addendum is made and entered this 4' day of 7)'r-e.4 , 1996, by and between Carl Clapp, hereinafter referred to as "Owner", and the City of Everett, a municipal corporation under the laws of the State of Washington, herein after referred to as the "City." WITNES SETH: WHEREAS, Owner has proposed to develop a parcel of property located at 103 Dorn Avenue, corner of Holly and Dorn, Everett Snohomish County, Washington, the legal description of which is as follows: Lots 1 & 2 Replat of Lot 15, Beverly Garden Tract No. 1 in Section 13 T. 28 R.4 NWM ; and WHEREAS, On June 3, 1981, the City of Everett passed Ordinance No. 790-81, along with a Concomitant Agreement dated June 3, 1981 , hereinafter referred to as "Agreement" amending the official zoning map of the City of Everett upon compliance with conditions contained in said agreement; and WHEREAS, Owner has made application to amend the conditions of approval of agreement to allow the construction of a thirteen (13) unit apartment building; and WHEREAS, the Hearing Examiner made a recommendation on January 9, 1996, to the City Council to grant approval to this Addendum to said Agreement to Ordinance No. 790-81; and WHEREAS, the City Council held a public hearing and approved the Hearing Examiner's recommendation to adopt this Addendum; and WHEREAS, the Owner has agreed to develop the aforementioned property in accordance with said Agreement and this Addendum; NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: I. That the Agreement is hereby amended as follows:
