Exhibit "1" <br /> Addendum to Concomitant Agreement <br /> to Ordinance No. 790-81 <br /> THIS Addendum is made and entered this 4' day of 7)'r-e.4 , 1996, <br /> by and between Carl Clapp, hereinafter referred to as "Owner", and the City of Everett, a <br /> municipal corporation under the laws of the State of Washington, herein after referred to as <br /> the "City." <br /> WITNES SETH: <br /> WHEREAS, Owner has proposed to develop a parcel of property located at 103 Dorn <br /> Avenue, corner of Holly and Dorn, Everett Snohomish County, Washington, the legal <br /> description of which is as follows: <br /> Lots 1 & 2 Replat of Lot 15, Beverly Garden Tract No. 1 in Section 13 T. 28 <br /> R.4 NWM <br /> ; and <br /> WHEREAS, On June 3, 1981, the City of Everett passed Ordinance No. 790-81, <br /> along with a Concomitant Agreement dated June 3, 1981 , hereinafter referred to as <br /> "Agreement" amending the official zoning map of the City of Everett upon compliance with <br /> conditions contained in said agreement; and <br /> WHEREAS, Owner has made application to amend the conditions of approval of <br /> agreement to allow the construction of a thirteen (13) unit apartment building; and <br /> WHEREAS, the Hearing Examiner made a recommendation on January 9, 1996, to <br /> the City Council to grant approval to this Addendum to said Agreement to Ordinance <br /> No. 790-81; and <br /> WHEREAS, the City Council held a public hearing and approved the Hearing <br /> Examiner's recommendation to adopt this Addendum; and <br /> WHEREAS, the Owner has agreed to develop the aforementioned property in <br /> accordance with said Agreement and this Addendum; <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> I. That the Agreement is hereby amended as follows: <br />
