• <br /> • <br /> A. Adequate sanitary facilities are provided and accessible at or near the camp site; <br /> B. Adequate trash receptacles and trash collection is to be provided; <br /> C. The camping activity will not unreasonably disturb or interfere with the peace, <br /> comfort and repose of private property owners; and <br /> D. The camping activity is not reasonably likely to cause injury to persons or <br /> property, to provoke disorderly conduct or create a disturbance. <br /> The Chief of Police is authorized to promulgate rules and regulations regarding the <br /> implementation and enforcement of this ordinance. <br /> No permit shall be issued for a period of time in excess of seven (7) calendar days. <br /> Any person denied a permit may appeal the denial to City Council. Notice of appeal must <br /> be in writing, and filed with the City Clerk within seven (7) calendar days from the date <br /> notice of the denial is received. <br /> Section 7: Codification <br /> Sections 1, 2, 3, 4, 5 and 6 of this ordinance shall be codified as six sections of a new <br /> chapter of Everett Municipal Code Title 8 - Health and Safety, to be titled "Camping." <br /> Section 8: Repealer. <br /> Everett Municipal Code section 9.06.140, relating to camping in parks, is hereby repealed. <br /> Section 9: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or <br /> its application to any person or situation be declared unconstitutional or invalid for any <br /> reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City <br /> of Everett hereby declares that it would have adopted this ordinance and each section, <br /> subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one <br /> or more sections, subsections, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> Section 10: Third Party Liability <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety <br /> and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or <br /> benefited by the terms of this ordinance. <br /> CAMPING ORDINANCE Page 3 <br />
