• <br /> 9) Variety Package. A package intended for retail sale, <br /> containing two or more individual packages or units of <br /> similar, but not identical, commodities. Commodities that <br /> are generically the same, but that differ in weight, <br /> measure, volume, appearance, or quality, are considered <br /> similar but not identical. <br /> Section 3 : Recognition of systems. <br /> The system of weights and measures in customary use in the United <br /> States and the metric system of weights and measures are jointly <br /> recognized, and either one or both of these systems shall be used <br /> for all commercial purposes in the City. The definitions of <br /> basic units of weight and measure, the tables of weight and <br /> measure, and the weights and measures equivalents, as published <br /> by the National Institute of Standards and Technology (NIST) , are <br /> recognized and shall govern weighing and measuring equipment and <br /> transactions in the City. <br /> Section 4 : Requirements for weighing and measuring devices. <br /> A) The specifications, tolerances, and other technical <br /> requirements for commercial, law enforcement, data gathering, and <br /> other weighing and measuring devices as adopted by the National <br /> Conference on Weights and Measures and published in National <br /> Institute of Standards and Technology Handbook 44 , <br /> "Specifications, Tolerances, and Other Technical Requirements for <br /> Weighing and Measuring Devices, " and supplements thereto or <br /> revisions thereof, shall apply to weighing and measuring devices <br /> in the City, except insofar as modified or rejected herein. <br /> B) The owner, leasee or user of any weighing or measuring <br /> equipment and devices in service and all mechanisms and devices <br /> attached thereto or used in connection therewith shall <br /> continuously maintain such equipment in proper operating <br /> condition throughout the period of such service. Maintenance of <br /> such equipment shall be in accordance with the National Institute <br /> of Standards and Technology Handbook 44 . <br /> Section 5: Requirement for Type Evaluation. <br /> The Uniform Regulation for National Type Evaluation as adopted by <br /> the National Conference on Weights and Measures and published in <br /> National Institute of Standards and Technology Handbook 130, <br /> "Uniform Laws and Regulations, " and supplements thereto or <br /> revisions thereof, shall apply to type evaluation in the City, <br /> except insofar as modified or rejected herein. <br /> Section 6: Title - Gender <br /> Any reference to or use of the terms "he" , "she" , "him" , "her" or <br /> other gender-based classification, if applicable as shown by the <br /> context thereof, shall apply to the opposite gender also. <br /> Section 7 : Field standards and equipment. <br /> There shall be supplied by the City such City Standards and field <br /> standards and such equipment as may be found necessary to carry <br /> out the provisions of this ordinance. The City standards shall <br /> be verified by a state weights and measures office upon their <br /> initial receipt and at least once each five years thereafter. <br /> 6 <br />
