• 9) Variety Package. A package intended for retail sale, containing two or more individual packages or units of similar, but not identical, commodities. Commodities that are generically the same, but that differ in weight, measure, volume, appearance, or quality, are considered similar but not identical. Section 3 : Recognition of systems. The system of weights and measures in customary use in the United States and the metric system of weights and measures are jointly recognized, and either one or both of these systems shall be used for all commercial purposes in the City. The definitions of basic units of weight and measure, the tables of weight and measure, and the weights and measures equivalents, as published by the National Institute of Standards and Technology (NIST) , are recognized and shall govern weighing and measuring equipment and transactions in the City. Section 4 : Requirements for weighing and measuring devices. A) The specifications, tolerances, and other technical requirements for commercial, law enforcement, data gathering, and other weighing and measuring devices as adopted by the National Conference on Weights and Measures and published in National Institute of Standards and Technology Handbook 44 , "Specifications, Tolerances, and Other Technical Requirements for Weighing and Measuring Devices, " and supplements thereto or revisions thereof, shall apply to weighing and measuring devices in the City, except insofar as modified or rejected herein. B) The owner, leasee or user of any weighing or measuring equipment and devices in service and all mechanisms and devices attached thereto or used in connection therewith shall continuously maintain such equipment in proper operating condition throughout the period of such service. Maintenance of such equipment shall be in accordance with the National Institute of Standards and Technology Handbook 44 . Section 5: Requirement for Type Evaluation. The Uniform Regulation for National Type Evaluation as adopted by the National Conference on Weights and Measures and published in National Institute of Standards and Technology Handbook 130, "Uniform Laws and Regulations, " and supplements thereto or revisions thereof, shall apply to type evaluation in the City, except insofar as modified or rejected herein. Section 6: Title - Gender Any reference to or use of the terms "he" , "she" , "him" , "her" or other gender-based classification, if applicable as shown by the context thereof, shall apply to the opposite gender also. Section 7 : Field standards and equipment. There shall be supplied by the City such City Standards and field standards and such equipment as may be found necessary to carry out the provisions of this ordinance. The City standards shall be verified by a state weights and measures office upon their initial receipt and at least once each five years thereafter. 6
