• <br /> • <br /> approval for the establishment, location or licensing of jails and correctional <br /> facilities in the City for a period of six (6) months beginning on the effective date <br /> of this ordinance. Provided, prior to the expiration of said six (6) month period, <br /> should the City Council adopt an ordinance amending the Zoning Code concerning <br /> the siting of jails and correctional facilities, this ordinance shall terminate upon the <br /> effective date of said ordinance. <br /> Notwithstanding any language herein, the rights of the Denny Youth Center <br /> generally located at 10th and Pine, the Second Chance juvenile transition facility to <br /> be located generally at 40th and Smith Street, and the Snohomish County Jail <br /> generally located at 1918 Wall Street shall not be affected by this ordinance as they <br /> relate to these identified locations. <br /> Section 2: Conflict. In the event there is a conflict between the provisions of this <br /> ordinance and any other City regulation, the provisions of this ordinance shall control. <br /> Section 3: Severability. If any section, subsection, sentence, clause, phrase or word of <br /> this ordinance should be held to be invalid or unconstitutional by a court of competent <br /> jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or <br /> constitutionality of any other section, subsection, sentence, clause, phrase or word of this <br /> ordinance. <br /> Section 4: Emergency Clause. It is necessary to pass this ordinance as an emergency to <br /> preserve the status quo. If not adopted as an emergency ordinance, there would be a <br /> period of time during which jails and correctional facilities could obtain a vested right to <br /> locate inconsistent with the City's proposed Zoning Code amendment. This ordinance is <br /> necessary for the immediate preservation of the public peace, health and safety. The City <br /> Council declares that an emergency exists, and /s ordinance shall take effect <br /> immediately. <br /> _�1J`�r/ <br /> ' I D.
