RESOLUTION NO. 6 5 0 3 <br /> A RESOLUTION authorizing recovery of abatement costs pursuant to EMC 1.20.090 at <br /> 5630 Commercial Avenue. <br /> WHEREAS, the Everett Municipal Code (the "EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS, on December 29, 2011,the City of Everett Violations Hearing Examiner <br /> issued an Order against the property owner and occupants (collectively, the "Respondents") for <br /> EMC violations at 5630 Commercial Avenue (the "Property"), parcel number 00495801302200, <br /> and abbreviated legal description: <br /> LAUREL HEIGHTS BLK 013 D-00 - LOT 22 <br /> ; and <br /> WHEREAS the Respondents did not abate the violations, including removal of garbage <br /> and overgrown vegetation on the exterior of the property, by the date set in the Order; and <br /> WHEREAS,the property owner agreed that the City would abate the violations at his <br /> cost, and that those costs together with any penalties imposed by the Hearing Examiner may <br /> become a lien against his property if he failed to reimburse the City the abatement costs; and <br /> WHEREAS,the City incurred costs in the amount of$2051.48 in its abatement of the <br /> violations and the Hearing Examiner imposed a penalty of$3,500 against the Respondents; and <br /> WHEREAS, notice of Council's consideration of this Resolution was provided to the <br /> property owner; and <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Everett that the <br /> total cost of abatement, including penalties assessed against the property owner, in the amount of <br /> $5,551.48 is confirmed.
