Cyberstalking is committed <br />when a person, with intent to harass, intimidate, torment or embarrass another person, makes an electronic <br />communication to that person, via means other than the telephone, that is obscene, anonymous, repeated and <br />or threatening. This crime is becoming more and more common due to the advances in communications <br />technology and is appropriate to include in the City's criminal code. In addition to defining and providing <br />the penalty for the crime of Cyberstalking, this proposed ordinance updates the penalty for telephone <br />harassment from misdemeanor to gross misdemeanor and amends other telephone harassment -related <br />ordinance sections to include Cyberstalking. <br />RECOMMENDATION (Exact action requested of Council): Adopt an Ordinance Relating to Telephone <br />Harassment and Cyberstalking, Amending Sections 32, 33 and 34 of Ordinance No. 1145-85 (EMC <br />10.18.010, 10.18.020 and 10. 18.030) and Sections 1 (part) and 6 of Ordinance No. 1521-88 (EMC <br />10.23.050), and adding a Section to Ordinance No. 1145-85 (the City of Everett Criminal Code). <br />
