• <br /> 4. Any such Fire Marshal Order shall be forthwith complied with as set forth <br /> in said order within the time or times therein prescribed. Any person upon whom <br /> such order is served, may take an appeal of such order and seek review thereof with <br /> the Board of Appeals, provided such appeal is filed within thirty (30) calendar days <br /> after service of such order. <br /> 5. In the event that any such person seeking a review before the Board of <br /> Appeals fails to comply with all of the steps herein set forth, then any member of <br /> said Board of Appeals or the City Attorney for the City of Everett may dismiss such <br /> appeal upon motion and if all of the steps for appeal have not been complied with, <br /> the appeal of such party shall be dismissed by the Board of Appeals. All decisions <br /> of the Board of Appeals shall be final. <br /> Section 10: The 1994 Edition of the UFC is each amended by the addition of the <br /> following section: <br /> It is expressly the purpose of this Code to provide for and promote the health, <br /> safety and welfare of the general public, and not to create or otherwise establish or <br /> designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this Code. <br /> It is the specific intent of this Code to place the obligation of complying with its <br /> requirements upon the permit applicant and any person owning, operating or <br /> controlling any building or structure within the scope of this Code that no provision <br /> nor term used in this Code is intended to impose any duty whatsoever upon the City <br /> or any of its officers or employees for whom the implementation or enforcement of <br /> this Code shall be discretionary and not mandatory. <br /> Nothing contained in this Code is intended to be nor shall be construed to create or <br /> form the basis for any liability on the part of the City or its officer, employees or <br /> agents, for any injury or damage resulting from the failure of a building to comply <br /> with the provisions of this Code, or be reason or inconsequence of any inspector, <br /> notice, order, certificate, permission or approval authorized or issued or done in <br /> connection with the implementation or enforcement of this Code, or by reason of <br /> any action of the City related in any manner to the enforcement of this Code by its <br /> officers, employees or agents. <br /> Notwithstanding any language used in this Ordinance and/or the Codes enacted <br /> herein, it is not the intent of this Ordinance to create a duty and/or cause of action <br /> running to any individual or identifiable person but rather any duty is intended to <br /> run only to the general public. <br /> Section 11: The City of Everett hereby declares that should any section, paragraph, <br /> sentence or word of this Ordinance or of the UFC or UFCS hereby adopted be declared for <br /> any reason to be invalid, it is the intent of the City of Everett that it would have passed all <br /> portions of this Ordinance independent of the elimination herefrom of any such portion as <br /> may be declared invalid. <br /> 5 <br />
