and inserting in its place: <br /> Sec. 203.1 General. In order to hear and decide appeals of orders, decisions or <br /> determinations made by the Building Official relative to the application and <br /> interpretation of this code, there shall be and is hereby created a Board of <br /> Review pursuant to Ordinance No. 351-75 as amended or hereafter superseded. <br /> Appeals from written orders of the Building Official must be filed within thirty <br /> (30) calendar days from the date of receipt of the written order by the aggrieved <br /> party unless there is an order issued to vacate in which case the appeal shall be <br /> filed within ten (10) days from the date of service of the order. The aggrieved <br /> party shall cause to be made at his own expense any tests or research required to <br /> substantiate his claim. <br /> D. Section 204 of the Uniform Housing Code, 1994 Edition, is hereby amended by <br /> adding: <br /> Any person, firm or corporation violating any provision of this Code shall be <br /> deemed guilty of a misdemeanor and, upon conviction thereof, shall be <br /> punishable by a fine not to exceed one thousand dollars ($1,000) or by <br /> imprisonment in jail not to exceed ninety (90) days, or both fine and <br /> imprisonment. Each separate day or any portion thereof, during which any <br /> violation of this Code occurs or continues, shall be deemed to constitute a <br /> separate offense and, upon conviction thereof, shall be punishable as herein <br /> provided. The issuance or granting of a permit or approval of plans and <br /> specifications shall not be deemed or construed to be a permit for, or an <br /> approval of, any violation of any of the provisions of this Code. No permit <br /> presuming to give authority to violate or cancel the provisions of this Code shall <br /> be valid, except insofar as the work or use which it authorized is lawful. <br /> E. The Uniform Housing Code, 1994 Edition, is hereby amended by the addition <br /> of the following section: <br /> Authority to Abate <br /> a) Any violation of the Code is hereby declared to a nuisance. <br /> b) Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute injunction, mandamus, or other appropriate action <br /> or proceeding to prevent the violation of this Code. <br /> 3 <br />
