D. The State Energy Code and the State Ventilation and Indoor Air Quality Code <br /> are amended by the addition of the following: <br /> Board of Appeals <br /> In order to hear and decide appeals of orders, decisions or determinations made <br /> by the Building Official relative to the application and interpretation of this <br /> code, there shall be and is hereby created a Board of Review pursuant to <br /> Ordinance No. 351-75 as amended or hereafter superseded. Appeals from <br /> written orders of the Building Official must be filed within thirty (30) calendar <br /> days from the date of receipt of the written order by the aggrieved party. The <br /> aggrieved party shall cause to be made at his own expense any tests or research <br /> required to substantiate his claim. <br /> Section 3: The City of Everett hereby declares that should any section, paragraph, <br /> sentence or word of this ordinance, the State Energy Code or the State Ventilation and <br /> Indoor Air Quality Code hereby adopted be declared for any reason to be invalid, it is <br /> the intent of the City of Everett that it would have passed all portions of this ordinance <br /> and Code independent of the elimination herefrom of any such portion as may be <br /> declared invalid. <br /> Section 4: This Ordinance shall not be construed nor held to repeal Ordinance No. <br /> 1882-92 as to any offense committed against such former ordinance or as to any act <br /> done, any penalty, forfeiture or punishment so incurred, or any right accrued or claim <br /> arising under the former ordinance, or in any way whatever to affect any such offense <br /> or act so committed or so done, or any penalty, forfeiture or punishment so incurred or <br /> any right accrued or claim arising before this ordinance takes effect. <br /> Nothing contained in this section shall be construed as abating any action now pending <br /> under or by virtue of Ordinance No. 1614-89; or as discontinuing, abating, modifying <br /> or altering any penalty accrued or to accrue, or as affecting the liability of any person, <br /> firm or corporation, or as waiving any right of the City u•.er Ordinance No. 1882-92 <br /> or provision thereof in force at the time of passage of is . dinance <br /> ATT ST: Carl Gipson, Mayor Pro-Tem <br /> 40ide <br /> fir►IL, aat ✓� <br /> CI Y CLERK <br /> Passed: 07/05/95 <br /> Valid: 07/07/95 <br /> Published: 07/14/95 <br /> Effective: 07/23/95 <br /> 3 <br />
