• <br /> 1. Increasing the number of dwelling units further above the number allowed by this <br /> Title; or <br /> 2. Decreasing the number of parking spaces further below the minimum required by <br /> this Title, except as may otherwise be provided in this Title. <br /> Section 2: Section 38.090 of Ordinance#1671-89, as amended (EMC 19.38.090), which reads: <br /> Expansion of nonconforming use or building. <br /> A. Where this chapter provides for expansion of a nonconforming use or building <br /> using Review Process III.B, the following evaluation criteria shall be used in the <br /> evaluation of such proposal: <br /> 1. The impact of traffic generated by the proposed use on the surrounding area, <br /> pedestrian circulation and public safety, and the proposal's ability to mitigate <br /> potential impacts. <br /> 2. Has sufficient lot size to provide for off-street parking, landscaping and screening <br /> from adjacent uses. <br /> 3. Whether the proposal provides a service to the general area. <br /> 4. The adequacy of streets, utilities and public services to accommodate the <br /> proposed use. <br /> 5. Compatibility of the proposed use or building to surrounding properties, <br /> especially as it relates to size, height, location and setback of buildings. <br /> 6. The number, size and location of signs and lighting of the proposed use, <br /> especially as they relate to more sensitive land uses. <br /> 7. The proposal's landscaping, buffering and screening of parking, loading and <br /> storage areas. <br /> 8. The proposal's generation of nuisance irritants such as noise, smoke, odor, glare, <br /> visual blight or other undesirable environmental impacts. <br /> 9. The proposal's consistency with the goals and policies of the Everett general plan <br /> and the purpose of the zone in which it is located. <br /> 10. The proposal's consistency with the environmental policies as stipulated in the <br /> city's SEPA ordinance. <br /> 11. The proposal's compliance with other provisions of this title, other city, state and <br /> federal regulations. <br /> B. Maximum Amount of Expansion. A nonconforming use or building shall not be <br /> permitted to expand by more than twenty-five percent of the land area or gross floor area <br /> developed to the nonconforming use or building at the time that such use or building <br /> became nonconforming. <br />
