In preliminary meetings with City Engineering Department staff, it was
determined that for traffic safety reasons, the driveway to serve the new development needed to be located on the
southern portion of the property. A City of Everett water main currently runs across the northeastern portion of the
property in an easement affecting the property at 12728 19th and the adjacent parcel to the north at 12704 19th
Avenue SE. There is also a public sewer main that runs through the northeastern portion of the property being
developed that is not within an easement.
To facilitate placement of the proposed driveway on the southern portion of the property, the developer has agreed
to relocate both the water and sewer main at the developer's sole expense. The developer will grant a new 27.5
foot wide easement to the City to accommodate the relocated utilities.
The proposed Quit Claim of Easement Rights will not be recorded until approval and acceptance of the relocated
utilities and easements to the City have been finalized.
RECOMMENDATION (Exact action requested of Council):
Authorize the Mayor to sign the Quit Claim of Easement Rights at 12704 and 12728 19th Avenue SE.
V9
