This ordinance defines graffiti defacement and the possession of graffiti implements and <br /> paraphernalia when the possessor of such intends to use them to deface public or private property as gross <br /> misdemeanor crimes,consistent with penalties for State crimes of malicious mischief and making or <br /> possessing of motor vehicle theft tools. This ordinance also provides for the use of public funds to support <br /> removal of graffiti from private property,as part of a pilot program. <br /> This proposed ordinance is intended to be one component of the City's comprehensive response to graffiti. <br /> In addition to this ordinance,City Administration is proposing a six-month graffiti removal"pilot program" <br /> under which the City would contract with a graffiti removal service provider to remove graffiti from <br /> residential private property that has been defaced by graffiti. Property owners who are required by city code <br /> to remove graffiti from their property would have the opportunity to participate in the pilot program in lieu of <br /> removing the graffiti at their own expense. Existing City staff in the Code Compliance unit of the Everett <br /> Police Department and City Administration will manage the pilot program. The intent of the program is to <br /> encourage and promote the swift removal of graffiti,improve the value and aesthetics of neighborhoods and <br /> discourage future occurrences of graffiti defacement. <br /> RECOMMENDATION(Exact action requested of Council):Adopt an Ordinance Relating to Prohibition, <br /> Prevention and Removal of Graffiti,Adding a New Chapter to the Everett Criminal Code,Title 10 of the <br /> Everett Municipal Code(Ordinance No. 1145-85). • <br />
