3. Payments for May and June 2008 shall, effectively, be adjusted <br /> based upon mutual agreement of AAA and the City ,to reflect reduced <br /> costs to AAA during earlier months of the Agreement. This adjustment <br /> shall be implemented by the City not having to make the June 2008 <br /> payment in the amount of One Hundred Eight Thousand Three Hundred <br /> Thirty-three Dollars ($108,333.00) and receiving a credit against the July <br /> 2008 payment of Fifty Thousand Dollars ($50,000). <br /> 4. Commencing July 1, 2008, payments shall be made to AAA in equal <br /> installments, subject to adjustment as specified in Section 4(a)(2) and (3) <br /> of this Amendment, in the amount of Ninety Five Thousand Eight Hundred <br /> Thirty-three and 33/100 Dollars ($95,833.33) per month until termination <br /> of the Agreement on June 30, 2009. Contractor shall bill the City in the <br /> last week of the month preceding the month for which the payment is <br /> sought. Payments shall be made to Contractor on or about the first Friday <br /> of each month or as soon thereafter as practicable. <br /> 5. Section 25 of the Agreement shall be amended to read as follows: <br /> The parties agree that the City may issue a Request for Proposals for the <br /> provision of indigent defense services. <br /> 6.
