3. Payments for May and June 2008 shall, effectively, be adjusted based upon mutual agreement of AAA and the City ,to reflect reduced costs to AAA during earlier months of the Agreement. This adjustment shall be implemented by the City not having to make the June 2008 payment in the amount of One Hundred Eight Thousand Three Hundred Thirty-three Dollars ($108,333.00) and receiving a credit against the July 2008 payment of Fifty Thousand Dollars ($50,000). 4. Commencing July 1, 2008, payments shall be made to AAA in equal installments, subject to adjustment as specified in Section 4(a)(2) and (3) of this Amendment, in the amount of Ninety Five Thousand Eight Hundred Thirty-three and 33/100 Dollars ($95,833.33) per month until termination of the Agreement on June 30, 2009. Contractor shall bill the City in the last week of the month preceding the month for which the payment is sought. Payments shall be made to Contractor on or about the first Friday of each month or as soon thereafter as practicable. 5. Section 25 of the Agreement shall be amended to read as follows: The parties agree that the City may issue a Request for Proposals for the provision of indigent defense services. 6. All terms, conditions and provisions of the July 11, 2007, Agreement remain in full force and effect, except as expressly modified by this Amendment.
