AMENDMENT NO. 2 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF EVERETT <br /> AND <br /> PERTEET, INC. <br /> The City and Perteet Inc. agree to amend and modify their professional services agreement dated May <br /> 29, 2007 (the "Agreement") as follows: <br /> WHEREAS, Perteet Inc. and the City entered into an Agreement dated May 29, 2007 to provide <br /> engineering services for the General Engineering and Consulting(GEC) Management, Riverfront <br /> Development—Civil Projects, and <br /> NOW THEREFORE, the City of Everett and Perteet Inc. agree to amend and modify the Agreement as <br /> follows: <br /> 1. Modify Paragraph 4.c"Compensation" as follows: Total compensation, including all services of <br /> the Contractor and its subcontractors, subconsultants, and agents and their expenses shall not <br /> exceed a maximum of Two Million,Nine Hundred and Twenty Five Thousand Dollars <br /> ($2,925,000). The additional Work Activities and range of fees are as follows: <br /> (Known) Work Potential Fee Range <br /> 41st Street Extension Preload and Landfill Surcharge Phase 1 $700,000 - $825,000 <br /> Construction Services <br /> 2.
