I' U ,451,;.:, A i .4110 AMENDMENT NO. 4 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF EVERETT AND URS WHEREAS, URS and the City entered into an Agreement dated September 25, 2006 ("Agreement") to provide engineering services for the pre-design of the South End Interceptor— North Segment 36-in Sewer Line Protection; and WHEREAS, the City and Contractor desire to supplement the Agreement for the purpose of extending the completion date of the original contract; and WHEREAS, the parties amended the Agreement on November 7, 2006 to provide design services for the South End Interceptor North Segment 36-in Sewer Line Protection Project; and WHEREAS, the parties again amended the Agreement on April 9, 2007 to provide engineering support services during construction for the South End Interceptor North Segment 36-in Sewer Line Protection Project; and WHEREAS, the parties again amended the Agreement on November , 2007 to provide engineering design and engineering support services for a second segment of the sewer line protection project;and • WHEREAS, work is not yet complete on the Eclipse Mill Road sewer protection project for which URS will be providing design and construction observation services; and WHEREAS, the Agreement as amended is likely to expire prior to completion of those projects and the parties expect the work to be competed by June 30, 2011; and WHEREAS, the City of Everett desires continued assistance from URS for such services on those projects; and WHEREAS, the City and URS agree to amend their Agreement to extend the time for completion to June 30, 2011; NOW THEREFORE, the City of Everett and URS agree to amend and modify the previously amended Agreement as follows: A. Paragraph 3 of the Agreement is amended to read as follows: r^ 3. Time of Beginning and Completion of Performance. This Agreement shall commence as of the date of execution of this Agreement and shall be completed by June 30, 2011. Page 1 of 2
