Section 14: The Land Use Element of the Everett Growth Management Comprehensive Plan, as <br /> established by Ordinance No. 2021-94 is hereby revised by the addition of the following policy to <br /> the Industrial Land Use Policies: <br /> 1.3.11 In order to promote greater land use compatibility with adjoining properties <br /> designated "Office and Industrial Park", land designated "Heavy Manufacturing" which <br /> has direct access to Hardeson Road shall have greater limitations on the range of <br /> permitted heavy industrial uses than otherwise allowed in the M-2 zone. Site <br /> development shall provide a substantial evergreen buffer within or adjacent to the Merrill <br /> and Ring Creek stream corridor so as to create an attractive gateway corridor and to <br /> screen the heavy industrial uses from the office and industrial park zoning on the east side <br /> of Hardeson Road. Until the zoning code is amended, the following requirements shall be <br /> implemented through private covenants and restrictions which have been voluntarily <br /> applied by the landowner and developer to sites in this "heavy manufacturing" area: <br /> Prohibited uses: Asphalt or concrete batch plants, vehicle impound yards, truck <br /> maintenance services except as accessory use to a permitted transportation activity, uses <br /> requiring outdoor storage of bulk or raw materials that cover more than 50% of the lot <br /> area, petroleum refineries, cement manufacturing, blast furnaces, smelting, drop forge <br /> industries, fertilizer manufacture, sanitary landfills, solid waste transfer stations, waste to <br /> energy facilities, electrical power generating facilities, sewage treatment plants except for <br /> industrial pre-treatment for on-site uses, and composting facilities. <br /> Landscaping: A "see through buffer" meeting the requirements of Type II landscaping as <br /> described in the zoning code shall be planted along the Hardeson Road frontage within or <br /> adjacent to the Merrill and Ring Creek stream corridor, as permitted by the regulations of <br /> Section 37 of the zoning code. The requirements of Landscape Category D, as described <br /> in the zoning code, shall apply to interior lot lines. As an alternative to these standards, <br /> the property owner may propose a master landscaping plan for Planning Director approval <br /> for all lots within the subject area that provides a landscaping treatment equivalent or <br /> superior to the requirements described herein. <br /> Section 15: The Land Use Map of the Everett Growth Management Comprehensive Plan as <br /> established by Ordinance No. 2021-94 is revised as provided in this Ordinance and the Official <br /> Land Use Map in the Planning Department of the City of Everett shall be revised as herein above <br /> provided. Should any section, subsection, paragraph, sentence, clause or phrase set forth in this <br /> ordinance or its application to any person or situation be declared unconstitutional or invalid for <br /> any reason, such decision shall not affect the validity of the remaining portions of this ordinance <br /> or its application to any other person or situation. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and each section, subsection, sentence, clause, <br /> phrase or portion thereof irrespective of the fact that any one or more sections, subsections, <br /> sentences, clauses, phrases or portions be declared invalid or unconstitutional. <br /> 15 <br />
