WHEREAS, Remedial Investigation and Feasibility Study (RIFS) work at the City of <br /> Everett landfill/tirefire site has identified some adverse environmental impacts at the City's old <br /> landfill site which must be mitigated and which mitigation the City Council finds is, historically, an <br /> appropriate function of the Solid Waste Management Utility which is necessary in order that the <br /> landfill site continue as a solid waste disposal site and be available for other possible solid waste <br /> handling activities in the future; and <br /> WHEREAS, to establish the public portion of said waste reduction and recycling and solid <br /> waste programs, to continue City involvement in solid waste management, and to mitigate the <br /> adverse environmental impacts associated with the City of Everett landfill/tirefire site it is <br /> necessary to continue a City of Everett Solid Waste Management Utility and to establish charges <br /> for said service; <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The City of Everett Solid Waste Management Utility, as established under <br /> Ordinance 1543-88 shall continue and is authorized to undertake all activities authorized by law <br /> for garbage and solid waste handling including recycling operations and specifically including <br /> mitigation of the old landfill property on 36th St. east of the I-5 freeway; provided that said utility <br /> is not authorized to engage directly in garbage and solid waste collection, except for hard-to- <br /> manage waste and/or city-wide clean-up projects and programs as the Mayor deems necessary to <br /> promote and facilitate waste reduction, recycling and disposal. <br /> Section 2: The Utility shall be under the direct management of the Mayor using such <br /> staff and consultant services as the Mayor deems appropriate. The Mayor is authorized to <br /> contract, as necessary, pursuant to state law, for solid waste management services and clean-up or <br /> mitigation activities. Any permanent City staff proposed for the Solid Waste Management Utility <br /> shall be identified in the Personnel Ordinance. <br /> Section 3: The 1995 budget for said utility shall be as established in Fund 402 <br /> (Resource Recovery). <br /> YJ:T1'0790RD(11/10/94) 2 <br />
