5.41 <br /> EVERETT <br /> ORDINANCE NO. 2,028 —94 <br /> AN ORDINANCE_of the City of Everett Rezoning Certain Property Located <br /> South of Everett Mall Way and West of 5th Place West <br /> From R-S (Suburban Residential) to C-1 (General Commercial) <br /> WHEREAS, Kurt Jensen, on behalf of Raymond G. Chinn, applied for a rezone for property <br /> located south of Everett Mall Way and west of 5th Place West, the legal description of which <br /> is: <br /> Lot 12, together with the west 20 feet of Lot 11, Plat of Moore's Addition to Olivia Park <br /> according to the Plat thereof as recorded in Volume 12 of Plats, Page 69, Records of <br /> Snohomish County, State of Washington; and <br /> WHEREAS, the City of Everett Land Use Hearing Examiner held a public hearing on October <br /> 6, 1994, to consider the proposed rezone and to take public testimony concerning the <br /> proposed rezone from R-S, Single Family Suburban Residential to C-1, General Commercial; <br /> and <br /> WHEREAS, the Hearing Examiner recommended that the City Council approve the proposed <br /> rezone of the subject property from R-S, Suburban Residential to C-1, General Commercial; <br /> and <br /> WHEREAS, the City Council held a public hearing on November 2, 1994, to consider the <br /> recommendation of the Hearing Examiner; and <br /> WHEREAS, the City Council finds that the proposed C-1 zoning satisfies the non-project <br /> rezone criteria contained in Section 41.160.D.4. of the Zoning code: <br /> 1. The proposed C-1 zoning is consistent with the designation on the Everett Growth <br /> Management Comprehensive Plan Land Use Map, which is consistent with the <br /> General Plan policies. <br /> 2. The proposed rezone bears a substantial relation to the public health, safety and <br /> welfare; and promotes the best long term interests of the Everett community. <br /> 3. The proposed rezone to C-1 is necessary to implement the Everett GMA <br /> Comprehensive Plan. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The zoning of the above described property is hereby changed from R-S, <br /> Suburban Residential to C-1, General Commercial. <br />
