• <br /> SECTION 6. OBSTRUCTING WATERSHED PATROL PROHIBITED <br /> A person commits the offense of obstructing the Watershed Patrol if: <br /> a. He/she intentionally uses or threatens to use force to obstruct a person <br /> he/she knows or should reasonably know is a Watershed Patrol person and <br /> while such Watershed Patrol person is performing his/her official duties on <br /> City property, within the corporate boundary of the City. <br /> b. He/she intentionally does any act that he/she knows or should reasonably <br /> know will interfere with or obstruct a person known to be or who should <br /> reasonably be known to be a Watershed Patrol person and while such <br /> Watershed Patrol person is performing his/her official duties within the <br /> corporate boundary of the City. <br /> SECTION 7. REFUSAL TO GIVE INFORMATION TO <br /> WATERSHED PATROL <br /> Any person requested to identify himself/herself to a Watershed Patrol person <br /> pursuant to an investigation of a potential or actual violation of this ordinance has <br /> a duty to identify himself/herself and give his/her current address. <br /> SECTION 8. VIOLATIONS <br /> Any person violating any provision of this Ordinance or failing to comply with its <br /> mandatory requirements shall, upon conviction of such violation, be punished by a <br /> fine of not more than $5,000.00 plus court costs. Each violation shall be treated as <br /> a separation violation <br /> SECTION 9. SEVERABILITY <br /> If any section, subsection, sentence, clause, phrase or any portion of this Ordinance <br /> is for any reason held to be invalid or unconstitutional by the decision of any court <br /> of competent jurisdiction, such decision shall not affect the validity of the <br /> remaining portions of this Ordinance. The City Council of the City of Everett <br /> hereby declares that it would have adopted this Ordinance and each section, <br /> subsection, sentence, clause, phrase or portion hereto or irrespective of the fact <br /> that any one or more sections, subsections, sentences, clauses, phrases or portions <br /> be declared invalid or unconstitutional. <br /> SECTION 10. THIRD PARTY LIABILITY <br /> It is expressly the purpose of this ordinance to provide for and promote the health, <br /> safety and welfare of the general public and not to create or otherwise establish or <br /> designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this ordinance. <br /> It is the specific intent of this ordinance that no provisions nor any term used in <br /> this ordinance is intended to impose any duty whatsoever upon the City or any of <br /> its officers or employees, for whom the implementation and enforcement of this <br /> ordinance shall be discretionary and not mandatory. <br /> Nothing contained in this ordinance is intended nor shall be construed to create or <br /> form the basis of any liability on the part of the City, or its officers, employees or <br />
