• <br /> • <br /> "fp <br /> /4/Z//---1 <br /> EL ffI'ETT <br /> ORDINANCE NO. 2015-94 <br /> AN ORDINANCE establishing rates and charges for <br /> industrial water; terms for connection to the <br /> City's Industrial Water supply facilities; <br /> and repealing Ordinance No. 1600-89. <br /> WHEREAS, the 1957 Water Contract, as amended, between Scott Paper Company and the City <br /> of Everett, has expired; and <br /> WHEREAS, the City Council desires, at this time, to continue to provide industrial water to <br /> Scott Paper Company at the cost-of-service based on principles similar to past industrial rate <br /> agreements by the City, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 1. Definitions. <br /> A. "Industrial water" shall mean water which is untreated or otherwise unsuitable as a source <br /> of supply for a public water system under the rules of the State Board of Health. (WAC <br /> 248-54) <br /> B. "Scott" shall mean Scott Paper Company. <br /> C. "Latecomer" shall mean any person other than Scott who shall apply for industrial water. <br /> 2. Industrial Water Facilities. Everett water system facilities dedicated for industrial water <br /> service shall not exceed 50 MGD peak capacity of which Scott's current peak demand is 40 <br /> MGD. Based on past agreements and participation in development of the Everett Water System, <br /> Scott shall have priority to receive industrial water. Delivery of industrial water shall be subject <br /> to rules and regulations established by the Director of Public Works. <br /> 3. Applications. All applications for industrial water shall be subject to approval by the <br /> Director of Public Works who shall disapprove any application which will violate state domestic <br /> water supply regulations. <br /> 4. Scott Rate. The rate for delivery of industrial water to Scott shall be based on cost of <br /> service principles in use under previous contract service and the cost of service shall be reviewed <br /> at least biennially and a monthly rate for industrial supply to Scott shall be set by Council <br /> resolution. <br /> AGR INWTRORD <br />
